Title:Duševna motnja in duševna manjrazvitost ter njun vpliv na kazensko odgovornost : magistrsko delo

Abstract:Duševna motnja in duševna manjrazvitost sta pojma, ki jima je skupen spremenjen način mišljenja, čustvovanja in zaznavanja. Za osebe z duševno motnjo ali drugo abnormalnostjo velja, da ne razumejo svojih dejanj in njihovih posledic. Sodišče s pomočjo psihiatričnega izvedenca pridobi oceno o duševnem stanju storilca, o njegovi sposobnosti za prestajanje sojenja in posledično tudi prištevnosti. V kazenskem pravu neprištevnost storilca v času izvršitve kaznivega dejanja pomeni, da ni kazensko odgovoren, saj se zaradi trajne hude duševne motenosti ne zaveda protipravnosti svojega ravnanja in ni sposoben samoobvladovanja. Sodišče se na podlagi ocene izvedenca odloči, če obstaja potreba za zdravljenje v psihiatrični ustanovi. Pregledna primerjava vrednostnih izhodišč pravne in medicinske stroke znotraj Slovenije pokaže na obstoj določenih pravnih praznin. V zakonskih določbah, ki so videti zadovoljivo urejene, se najde več kršitev človekovih pravic. Pogoste so etične dileme, kot je dvojni položaj psihiatra, prisilno pridržanje, varstvo podatkov... Pravni ureditvi kazenskega in zdravstvenega sistema se znotraj države pogosto razhajata, še bolj pa se sistemske ureditve razlikujejo med posameznimi državami. Za Veliko Britanijo, Združene države Amerike, Nemčijo in Slovenijo izvedena meddržavna primerjava zajema področja razvoja pravnega sistema, pomanjkljivosti zakonskih definicij, diagnostike duševnega zdravja oseb in dejanskega statusa duševnih bolnikov v zdravstvenem sistemu.

Title:Mental Disorder and Mental Under-Development and their Impact on the Criminal Liability
Abstract:Mental disorder and mental under-development have a common factor in altered thought process, feelings, and perception. Persons suffering from mental disorders and other abnormalities do not understand their actions and their consequences. Psychiatric expert provides an assessment of mental health, ability to stand trial, and determination of insanity of the perpetrator for the court. In criminal law, insanity of the perpetrator at the time of execution of the crime means that they do not bear criminal responsibility due to severe and permanent mental disability. They are not aware of unlawfulness of their actions and lack self-control. Based on the expert assessment, the court determines if treatment in mental institution is necessary. Comparative assessment of standpoints of legal and medical professions in Slovenia reveals existence of legal gaps. Seemingly appropriate legal acts contain several cases of human rights violations. Frequent examples are ethical dilemmas, such as double role of the psychiatrist, forced commitment, protection of personal data etc. Legal regulations of criminal and health systems in a country are often not aligned and even larger differences exist between countries. Comparative assessment of Great Britain, United States of America, Germany, and Slovenia encompasses the areas of legal system development, deficiencies in legal definitions, and diagnostics of mental health and actual status of persons with mental health disorder in health care system.
