Title:Lepotna tekmovanja in varstvo otrokovih pravic

Abstract:Temeljno načelo Konvencije Združenih narodov o otrokovih pravicah in Zakona o zakonski zvezi in družinskih razmerjih je načelo koristi otroka, ki je osnovno vodilo za ravnanje in postopanje staršev, institucij ter državnih organov, pri vseh dejavnostih, ki zadevajo otroka. Diplomsko delo je sestavljeno iz dveh delov. Prvi zajema pojem otroka in opis otrokovih pravic. Bistvena novost, ki jo prinaša KOP, je, da priznava otrokom tudi svoboščine. Svoboščine so posebna vrsta pravic do svobode govora, vere, združevanja, ki jih nekateri razlagalci KOP imenujejo »participativne pravice«. Kljub temu, da so svoboščine priznane vsakomur, jih vsi ne morejo udejanjiti. Udejanji jih lahko le nekdo, ki je kot umno bitje zmožen svobodne presoje in odločitev. KOP določa le, naj starši otroka pri uveljavljanju te pravice usmerjajo na način, prilagojen njegovim razvojnim zmožnostim. Ločeno poglavje je namenjeno opredelitvi in opisu lepotnih tekmovanj za otroke. Poglavje obravnava zgodovino in izvor otroških lepotnih tekmovanj. Prav tako predstavlja vse od samih priprav na lepotna tekmovanja do stroškov tekmovanja. Lepotna tekmovanja za otroke so obnorela svet, po drugi strani pa so sprožila še večji val zgražanja nad njimi, posledica česar je sprejetje zakona, ki v Franciji prepoveduje lepotna tekmovanja za otroke. »Law on real gender equality« je bil v Franciji sprejet 04. avgusta 2014, predstavlja pa do sedaj najpomembnejši mejnik na omenjenem področju. Številne države po svetu se po vzoru Francije sprašujejo, ali naj storijo enako.

Title:Beauty pageants and protection of children's rights
Abstract:The fundamental principle of the United Nations Convention on the Rights of the Child as well as the Law on conjugal union and the Family Relations prioritize the principle of child's benefits, which is the basic guide for the conduct and treatment of parents, institutions and state authorities in all activities affecting the child. The thesis consists of two parts. The first part presents the notion of a child and rights of children and their violations. The essential novelty of the United Nations Convention on the Rights of the Child is to acknowledge the freedoms to children as well. Freedoms are a special type of human rights to freedom of speech, expression and free association, religion, the right of the child to privacy, and the right of the child to his or her mental integrity, which some of interpreters of the Convention describe as “participatory rights”. Despite the fact that the freedoms are recognized to everyone, not everybody can actually realize them. United Nations Convention on the Rights of the Child stipulates only, that the parents should guide the child in a manner adjusted to his developmental abilities. A separate chapter aims at defining and describing beauty pageants for children. This chapter deals with the history and origins of child beauty pageants. It also represents all of their preparations for beauty pageants to the cost of the competition. Beauty pageants for children captivated the world and on the other hand, triggered an even bigger wave of indignation over them, resulting in the adoption of a law prohibiting beauty pageants for children in France. “Law on real gender equality” was adopted in France on August 4, 2014 and it represents the most important milestone in the field that is presented. Many countries around the world are asking, whether they should do the same, following the example of France.
