Title:Jasna in natančna določitev proizvodov in storitev pri registraciji znamke: analiza konkretnega primera

Abstract:Znamke so pomembna kategorija pravno zavarovanih pravic, ki v veliki večini primerov nastanejo le na podlagi registracije. Določitev blaga ali storitev je eden izmed elementov registracije, vendar predstavlja več kot zgolj formalnost, saj služi kot osnova za ugotovitev vsebine pravic iz znamke. Na prostoru EU so različni pristopi posameznih uradov k določitvi blaga ali storitev vodili v pravno negotovost. Sodba Sodišča EU v zadevi IP Translator naj bi to negotovost odpravila. Po kriteriju jasnosti in natančnosti, kot enem izmed pomembnejših izvlečkov iz zadeve IP Translator, mora prijavitelj pri določitvi blaga ali storitev upoštevati tudi interese pristojnih organov in gospodarskih subjektov, da imajo le ti možnost seznanitve z vsebino pravic iz znamke za katero se zahteva varstvo. V praksi, prijavitelji pri določitvi blaga ali storitev uporabljajo Nicejsko klasifikacijo. Sestavljena je iz 45 razredov, vsak razred pa ima splošne naslove, ki podajajo splošne informacije o blagu in storitvah zajetih v razredu. Pri določitvi blaga ali storitev z uporabo splošnih naslovov, sta se izoblikovala različna pristopa k interpretaciji takšne določitve in posledično je bilo vsebina znamke odvisna od pristopa, ki ga je sprejel posamezni urad. Zadeva IP Translator je razjasnila, da je uporaba splošnih naslovov razredov Nicejske klasifikacije dovoljena, v primeru, da zadosti kriterijem jasnosti in natančnosti. Močno je vplivala na sprejetje pristopa ''pomeni to, kar je zapisano'' interpretacije splošnih naslovov razredov Nicejske klasifikacije, kar pomeni, da splošni naslovi zavarujejo le tisto blago ali storitve iz posameznega razreda, ki dobesedno sodi v pomen tega naslova. Vpliv sodbe v zadevi IP Translator pa je viden tudi v sekundarni zakonodaji EU, ki vključuje dodatna določila glede določitve blaga ali storitve in sprejemu skupnih praks različnih uradov za intelektualno lastnino v EU o uporabi Nicejske klasifikacije in določitvi blaga ali storitev.

Title:Specification of goods and services for a trade mark registration : specific case analysis
Abstract:Trademarks are important category of rights protected by law, which in most cases are created by registration only. Specification of goods and services is one of the elements of registration however it presents more than just a formality as it serves as a basis for trademark content analysis. In European Union area there were divergent approaches of different officies when it comes to specification of goods and services which lead to legal uncertainty. Judgement of ECJ in case IP Translator was supposed to end this uncertainty. Criteria of clarity and precision as one of more important abtracts from IP Translator case, presents us with obligation of trademark applicant to consider . competent authorities and economic operators interests in ability to inform themselves with content arising from trademark for which protection is sought. In practice, aplicants use Nice classification when specifying goods and services. It is structured in forty-five classes with every class presented by a title that defines basic information about goods and services introduced in class. With use of general titles of Nice classification for specification of goods and service, two different approaches arose for interpretation of such a specification ultimately leading to trademark content being reliant on approach that was adopted by individual office. IP Translator case made it clear that use of general titles of Nice classification is allowed if it complies with critera of clarity and precision. It had a strong influence on adopting ''means-what-it-says'' approach to interpreting general titles of Nice classification which meant that general titles only protect goods and services that literally belong in meaning of the title. Influence of the judgement in IP Translator case is also seen in secondary legislation of EU, which adopts certain rules about specification of good and service and in accepting common practices from different offices for intellectual property about Nice classification use and goods and services specification.
