Title:Ukrepi inšpektorjev za delo v luči novejše sodne prakse Upravnega sodišča

Abstract:Na področju uveljavljanja in varstva pravic zaposlenih ima pomembno vlogo Inšpektorat Republike Slovenije za delo, ki opravlja nadzorstvo nad izvajanjem zakonov, drugih predpisov, kolektivnih pogodb in splošnih aktov, ki urejajo delovna razmerja, plače in druge prejemke iz delovnega razmerja, zaposlovanje delavcev doma in v tujini, sodelovanje delavcev pri upravljanju, stavke ter varnost delavcev pri delu. V okviru inšpektorata delujeta inšpekcija nadzora delovnih razmerij in inšpekcija nadzora varnosti in zdravja pri delu. Za inšpekcijski nadzor sta ključnega pomena vloga in položaj inšpektorja, ki ta nadzor v posameznih primerih tudi opravlja. Inšpektorjeva naloga je nadzirati izvajanje predpisov, ki so mu zaupani v nadzor, in ob ugotovljenih pomanjkljivostih in nepravilnostih z zakonitimi ukrepi zavezanca spodbuditi k ravnanjem, ki zagotavljajo spoštovanje predpisov. Načeloma je inšpektor dolžan to nalogo zagotoviti z ukrepi, ki so za zavezanca najmilejši, seveda ob pogoju, da so vse pomanjkljivosti in nepravilnosti v opredeljenem roku resnično tudi odpravljene. V nasprotnem primeru je inšpektor dolžan ukrepanje proti zavezancu stopnjevati, dokler ta ne izpolni njegovih zahtev, in to z vsemi zakonsko predpisanimi sredstvi. Namen diplomskega dela je predstaviti ukrepe inšpektorjev za delo s pomočjo analize novejše sodne prakse Upravnega sodišča Republike Slovenije. Upravno sodišče Republike Slovenije je pristojno za vse spore v zvezi z akti inšpektorjev, o pravnih sredstvih zoper njegovo odločitev pa odloča Vrhovno sodišče Republike Slovenije. Kadar odločitev inšpektorja vpliva na pravni položaj stranke v inšpekcijskem postopku, je to upravni akt, ki ga je mogoče izpodbijati v upravnem sporu. Upravni spor se v celoti uporablja za sodni nadzor nad akti inšpektorjev in je namenjen varstvu posameznikov in pravnih oseb, ki bi lahko bili z oblastveno odločbo inšpektorja prizadeti v svojem pravnem položaju. Takšna ureditev sodnega nadzora nad odločitvami inšpektorjev sledi temeljnim ustavnim zahtevam po učinkovitem pravnem sredstvu in sodnem varstvu zoper odločitve uprave.

Title:Labour inspectors' actions in the perspective of case law of the Administrative Court of the Republic of Slovenia
Abstract:In the area of enforcement and protection of employees' rights, the Labour Inspectorate of the Republic of Slovenia plays an important role in overseeing the implementation of laws, other regulations, collective agreements and general acts regulating labour relations, salaries and other reimbursement from employment, employment of workers at home and abroad, employee involvement in management, strikes and employees' safety at work. Inspection of the Employment Relationship and Inspection of Occupational Health and Safety Control are part of the Inspectorate. The role and position of the inspector, which in the individual cases also performs these controls, are crucial for inspection. The inspector's task is to supervise the implementation of the regulations entrusted to him for supervision, and, in the event of deficiencies and irregularities, encourage the business to conduct steps towards ensuring compliance with the regulations. In principle, the inspector is obliged to provide this task with the measures that are as mild as possible for the business, provided that all the deficiencies and irregularities are also eliminated by the defined deadline, of course. Otherwise, the inspector shall be obliged to step up the action against the person liable, until the requirements are met, with all the means authorised to him by the Slovenian regulations. The purpose of the final paper is to present the measures of the labour inspectors through the analysis of the recent case law of the Administrative Court of the Republic of Slovenia. The Administrative Court of the Republic of Slovenia has a jurisdiction over all disputes concerning acts of inspectors, and the Supreme Court of the Republic of Slovenia decides on legal actions against its decision. When the inspector's decision affects the legal position of a party in an inspection procedure, this is an administrative act that can be challenged in an administrative dispute. The administrative dispute is fully applicable to judicial review of acts of inspectors and is intended to protect individuals and legal entities, which might be affected by the authority decision of the inspector in their legal position. Such an arrangement of judicial review of the decisions of the inspectors follows the basic constitutional requirement for effective legal means and judicial protection against the decisions of the administration.
