Abstract:Gradbeništvo je nenehno izpostavljeno ekonomskim vplivom. Če se gradbena podjetja na negativne vplive ne odzovejo pravočasno, hitro zapadejo v stanje nelikvidnosti, kar vodi do insolventnih postopkov – prisilne poravnave ali stečaja. Prisilna poravnava bi morala z rekonstrukcijo dolgov zagotavljati pogoje za uspešno nadaljnje poslovanje, medtem ko sta cilja stečaja poravnava dolgov in prenehanje poslovne osebe. V diplomskem projektu smo na primeru slovenskih gradbenih podjetij raziskovali, zakaj postopek prisilne poravnave ne nudi dokončne rešitve za nezmožnost poravnave dolgov, temveč vodi samo v stečaj. V drugem delu diplomskega projekta smo raziskovali stanje gradbeništva v Rusiji in ruski stečajni postopek, ki se v primeru možnosti za rešitev podjetja začne s prisilno poravnavo ali stečajem, če te možnosti ni. V raziskavo smo vključili tudi avstrijsko zakonodajo in primerjali tri države – Slovenijo, Rusijo in Avstrijo.

Title:Methodology for resolving building companies of illiquidity and insolvency
Abstract:Construction industry is constantly exposed to economy's impact and construction companies quickly fall into the state of illiquidity, if they fail to respond to the negative impacts. This leads to insolvency procedures – compulsory settlement or bankruptcy. The purpose of compulsory settlement is restructuring the debt of the company. The main difference between bankruptcy and compulsory settlement proceedings is that the bankruptcy finishes with termination of the company as the legal entity. Through research of the Slovenian construction companies we have analysed, why compulsory settlement does not offer a final solution, but only leads to the bankruptcy. In the second part of the project we have focused on construction industry in Russia and their insolvency procedure, which, if there is a chance to safe company, beginns with compulsory settlement, or directly with bankruptcy. In our research we included Austria and compared Austrian legislation to the Slovenian and Russian.
