Abstract:V diplomskem delu se osredotočam na pravico do svobodne izbire osebnega imena, predvsem v primeru spremembe osebnega imena na prošnjo. Zanima me pravna ureditev spremembe osebnega imena, ali naš zakonodajni prostor in pravica do svobodne izbire osebnega imena na tem področju omogočata potencialne kolizije do drugih človekovih pravic. Diplomsko delo temelji na primerjalnopravni analizi zakonske ureditve spremembe osebnega imena. Primerjam italijansko, hrvaško in avstrijsko zakonsko ureditev spremembe osebnega imena s slovensko zakonsko ureditvijo. S pomočjo analize tuje in domače sodne prakse iščem odgovore na raziskovalna vprašanja. Na splošno me zanima, ali je naša zakonodaja v ustrezni meri primerna.

Title:The right of choosing a personal name
Abstract:In this diploma thesis, I focus on the right to freely choose a personal name, especially in the case of changing a personal name by request. I am interested in the legal system of changing a personal name, whether our legislative space and the right to freely choose a personal name create potential conflicts with other human rights. The diploma thesis is based on a comparative legal analysis in regard to the legal regulation of changing a personal name. I compare the Italian, Croatian and Austrian legislation in this area with the Slovenian legislation. Using the analysis of foreign and domestic case-law, I seek to answer the research questions. Overall, I am wondering if our legislation is appropriate.
