Abstract:V magistrski nalogi sem primerjal institut vročanja pred uveljavitvijo novele ZPP-E in po tem.

Title:Act amending the civil procedure act - service of documents
Abstract:In the master's thesis, I compared the institute of Service of Process before and after the introduction of the amendments to the Civil Procedure Act. If I briefly summarize the key findings I have learned during the writing of the diploma paper, I can assert that the legislature has modernized and coordinated the field of serving documents with legal regulation and case law. This process of serving documents has become faster, more reliable and more economical. In the course of the changes, the legislator was inspired by the foreign legal system, the jurisprudence of the higher courts, and adapted the procedure to the recent decisions of the Constitutional Court. In the field of electronic mail delivery service, he followed primarily other procedures in the field of criminal, administrative and land registry law, which are already regulated by electronic means. Documents are served by post, by secure electronic route, by court official, at court, at the request of the client by the detective or the executor and in the mailbox. The court serves documents by electronic means, if the person informs the court that he wishes the service on that way, or if the client uses an electronic route for filing his application. However, the court may, without the consent of the addressee, determine the service by electronic means if it fulfils certain conditions in the law. The court has the option to invite the client verbally to the next hearing, so that special service of invitations is not required. The court may also order direct service between lawyers, as mandatory. Unified are the rules of service for legal persons, including lawyers, notaries and self-governing local communities. Serving mail to lawyers is also equalized to the service of legal persons and other professional subjects. The law did not distinguish between personal and ordinary service of a secure electronic way. The same rules were applied to the all documents that were served on a secure electronic way. With the change, the legislature regulated the possibility of ordinary service of documents over an electronic way. A natural person with an unknown address is mail served to a new address automatically by the correspondent, if he knows address. If this is not possible, the court seeks an address in the registry or invites a counterparty to report a new address, and at the same time initiates the process of determining the actual residence or query with persons who might be aware of the new address.
