Title:Korupcija v slovenskem bančnem sektorju : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Namen diplomskega dela je bil raziskati elemente korupcije in bančnega sektorja z namenom ugotavljanja a) prisotnosti korupcije v bančnem sektorju v Republiki Sloveniji, b) vzroka nastanka korupcije v bančnem sektorju, c) vpliva oziroma posledic korupcijskih ravnanj na bančne institucije in državo oziroma družbo ter d) identifikacije ukrepov za preprečevanje korupcije na tem področju. S tem v zvezi smo po pregledu primarne in sekundarne literature s pomočjo raziskovalne metode študije primerov opravili kvalitativno analizo stališč strokovne javnosti in dostopnih primerov ugotovljene korupcije s strani organov pregona (Policije), Komisije za preprečevanje korupcije, Vrhovnega državnega tožilstva, Računskega sodišča in Preiskovalnega telesa državnega zbora. Raziskava je bila omejena na ozemlje Republike Slovenije in utemeljena korupcijska ravnanja v Sloveniji. Rezultati kažejo, da ima korupcija negativen vpliv na bančne institucije predvsem v premoženjskem smislu, saj se le-ta kaže v ogromnih finančnih stroških za banke in gospodarstvo, kar je v preteklosti celo privedlo do globalnih gospodarskih oziroma finančnih kriz. Poleg želje po večji moči in boljšem položaju, vpliva neformalnih mrež (nasprotja interesov) pa so k izvršitvi koruptivnih ravnanj predvsem pripomogle objektivne – sistemske pomanjkljivosti, in sicer neučinkovit nadzor in delovanje organov odkrivanja in pregona, slaba zakonodaja in nepreglednost postopkov. Slovenija bi morala za zmanjševanje vseh tveganj oziroma koruptivnih ravnanj v bančnem sektorju nujno urediti zakonodajno področje, izboljšati nadzor in skladnost poslovanja, povečati transparentnost in ureditev nasprotja interesov ter lobiranja.

Title:Corruption in slovenian banking sector
Abstract:The purpose of the thesis was to explore the elements of corruption and the banking sector, in order to determine a) the presence of corruption in the banking sector in the Republic of Slovenia, b) the cause of corruption in the banking sector, c) the impact or consequences of corruption practices in the banking institutions and the state or society, d) identification of measures to combat and prevent corruption in this area. In this respect, we are following an examination of primary and secondary literature using research methods case studies conducted qualitative analysis of the views of the professional public and accessible established cases of corruption to the law enforcement agencies (police), the Commission for Prevention of Corruption, the Supreme Public Prosecutor's Office, the Court of Auditors and investigative bodies the National Assembly, thus the influence and characteristics of corruption in the banking sector. The survey was limited to the territory of the Republic of Slovenia and justified corruption. The results show that corruption has a negative impact on banking institutions, particularly in pecuniary terms, as reflected in the huge financial costs for banks and the economy; in the past consequences have even led to the global economic and financial crises. Besides gaining more powers, better positions and the impact of informal networks (conflict of interest), causes to commit corrupt practices are mostly contributed by objective issues - systemic weaknesses, namely ineffective oversight and performance of law enforcement, poor legislation and lack of transparency in decision-making processes. To reduce risks or corrupt practices in the banking sector Slovenia would necessary need to regulate the legislative area, improve control and compliance of operations, increase transparency and regulation of conflict of interest and lobbying.
