Title:Delo policije in ekskluzija dokazov : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomski nalogi je predstavljen institut ekskluzije dokazov. Ta institut omogoča, da se zoper obdolženca ne uporabi dokazov pridobljenih s kršenjem ustave s strani države. Država na tak način poskuša zagotoviti enakost obeh strank, saj s svojim celotnim represivnim aparatom predstavlja veliko močnejšo stranko, kot je obdolženec, ki nima pravne podlage in za sabo celotne ekipe. Torej predstavlja ključni element za zagotavljanje človekovih pravic in temeljnih svoboščin posameznika v kazenskem postopku. Izvira iz ZDA in sicer iz 18. stoletja, od takrat dalje pa je deležen konstantnega spreminjanja ravno zaradi mešanja različnih tipov kazenskega postopka, ki so vplivali na drugačna stališča družbe in posledično drugačnega dojemanja tega instituta. Z uveljavitvijo doktrine sadežev zastrupljenega drevesa se je ekskluzija dokazov razširila tudi dokaze, ki so bili sicer pridobljeni zakonito vendar na podlagi nezakonitih dokazov. Omenjenemu institutu nasprotuje načelo iskanja materialne resnice, ki izvira iz inkvizicijskega kazenskega postopka. To načelo pa v nasprotju z ekskluzijo, postavlja v ospredje iskanje resnice o kaznivem dejanju, z namenom, da se kršitelja kaznuje. Institut ekskluzije dokazov vključno z doktrino zastrupljenega drevesa je uveljavljen tudi v slovenskem pravnem redu in sicer v 83. členu ter 18. členu Zakona o kazenskem postopku. Zanj je značilen radikalen način izločitve dokazov in za razliko od ZDA ne dopušča nikakršnega tehtanja med tem, ali je izločitev smiselna in ali bo izločitev imela vpliv na preventivno delo policije.

Title:Police work and the ekclusionary rule
Abstract:The main subject of this thesis is exclusionary rule. This institute is preventing the use of evidence against the accused, that were obtained by government's violation of the constitution. This way, the government is trying to provide equality of both clients in the case, where they represent a much stronger party against the accused, who has no knowledge of legal background and no legal team for help. Therefore, exclusionary rule represents a key element, that provides the protection of human and fundamental rights in criminal procedure. The roots of exclusionary rule were originated in the USA, in the middle of 18th century. From that time on, its form has constantly been transformed due to mixture of different types of criminal procedures, which influenced on society's standpoint towards this institute and consequently on varying perceptions of it. When the doctrine of the fruits of the poisonous tree was enforced, the exclusionary rule was expanded also on evidence, seized legally, but derived from evidence that were illegally obtained. The contradictory principle to the exclusionary rule is the principle of searching for material truth, which originates from inquisitionary criminal procedure. Its main tendency is to find the truth of the criminal act and to punish the lawbreaker. Exclusionary rule and the doctrine of the fruits of the poisonous tree are both established in Slovenian legal order, namely in Article 83 and 18 of Code of criminal procedure. Its main feature is radical exclusion of evidence, and as opposed to the USA, it does not allow any weighing between the sanity of the exclusion and its effect on preventive police work.
