Title:Participacija občanov pri sprejemanju splošnih aktov v občini

Abstract:Lokalne oblasti, v mejah zakona urejajo in opravljajo bistveni del javnih zadev v okviru svojih nalog in v korist lokalnega prebivalstva. Lokalna samouprava se tako v občini, ki je najožja, primarna naravna skupnost ljudi ukvarja predvsem z zadevami, ki se nanašajo na socialo, zdravstvo, izobraževanje, gospodarsko infrastrukturo in se torej tičejo vsakdanjega življenja in dela občanov. Lokalne oblasti so demokratične institucije, ki so zavezane k spoštovanju demokratičnih norm in standardov. Na procese odločanja v lokalni skupnosti med drugim vplivajo institucionalne povezave, lokalna politična kultura in participacija državljanov, lokalna oblast je demokratična le, če imajo občani možnost bodisi posredno ali neposredno, bistveno vplivati na njeno izvajanje. Leta 2009 je pričela veljati Resolucija o normativni dejavnosti, ki določa, da je za zagotavljanje legitimnosti sprejetih odločitev in zmanjševanje demokratičnega deficita potrebno pri pripravi odločitev omogočiti sodelovanja čim širšega kroga subjektov. Strategija med drugim določa načela ter minimalna priporočila, ki jih je potrebno upoštevati pri vključevanju javnosti. Po opravljenem raziskovanju ugotavljam, da participacija občanov v Sloveniji na lokalni ravni ni ustrezno urejena. Vse do danes lokalne skupnosti v svojih poslovnikih občinskih svetov v postopku sprejemanja splošnih aktov ne predvidevajo vključevanja javnosti v skladu s smernicami, ki v praksi predvidevajo ločevanje postopka priprave predpisov od postopka njihovega sprejemanja, v postopku priprave predpisa pa izvedbo splošne razprave in javne predstavitve. Implementacija Dodatnega protokola k Evropski listini lokalne samouprave o pravici do sodelovanja pri vprašanju lokalne oblasti na lokalni ravni ni zadovoljiva, kar se v praksi pogosto odraža v nezadovoljstvu občanov ter nezaupanju v izvoljene predstavnike. V magistrski nalogi na primeru Mestne občine Murska Sobota predlagam vključitev javnosti v postopek sprejemanja splošnih aktov, ki ga določa Poslovnik Mestnega sveta Mestne občine Murska Sobota. Na ta način se upoštevajo določila MDPELLS, s krepitvijo vpliva občanov na odločitve, ki jih sprejemajo organi lokalne samouprave, pa se poveča tudi zadovoljstvo občanov, ki so postavljeni v vlogo odločevalcev.

Title:Citizens participation at acceptance of general acts in municipalitys
Abstract:Local government related to the public good acts as the agent of the state for the benefit and welfare of its inhabitants. Local self-government basicaly deals with the matters within the competences that refer to the social services, health care, education, economically developed infrastructure and acts for peculiar and special advantages of its inhabitants in their everyday life. Local governments are democratic institutions that obey the rules of democratic standards. Local government is democratic only when its inhabitants can have a choice or possibility to influence on its working area, to carry out tasks directly and indirectly in connection with the founding organisation and operation of the region. In the year 2009 Normative Resolution came into force that determines legitimacy of accepted decisions and reduction of the democratic deficit and says that by making preparation of the decisions must be joined as many subjects as possible. Among the others this strategy defines the principles and minimal recommendations which have to be considered when public is included. After the research work I have found out that the participation of local inhabitants in Slovenia is not settled appropriately. Till today the local communities in their internal rules of their municipal council do not integrate public into the procedures of making decisions. The Implementation of Additional protocol to the European charter of the local self-management at the local area is not adequate and is therefore very often noticed as a dissatisfaction of its inhabitants and is also seen as a distrust to the elected representatives. In my dissertation on the example of the Municipality of Murska Soota I suggest the integration of the public into the matters of general files which is determined in the internal rules of the city council of the municipality of Murska Sobota. In this way the statutory provision of MDPELLS is considered by strengthening the role of the citizens by making decisions which are made by the local self-management and at the same time the satisfaction of citizens is strengthen when they are put into the role of decision-makers.
