Title:Grajeno javno dobro na nepremičninah v zasebni lasti

Abstract:Javno dobro je po Stvarnopravnem zakoniku (SPZ) stvar, ki jo v skladu z njenim namenom ob enakih pogojih lahko uporablja vsakdo. Status javnega dobrega se pridobi zgolj na podlagi splošnega ali posamičnega pravnega akta. 19. člen SPZ tako navaja, da je javno dobro nepremičnina, ki ji ustrezen pravni akt države ali lokalne skupnosti podeli status javnega dobrega. Zakon o urejanju prostora (ZUreP-2), ki bo s 1.6.2018 postal tudi matični predpis glede ureditve instituta grajenega javnega dobrega, prinaša spremembo zakonodaje na omenjenem področju. Tako je rdeča nit dotične naloge z naslovom Grajeno javno dobro na nepremičninah v zasebni lasti, primerjava med določbami sedaj veljavnega Zakona o graditvi objektov (ZGO-1) in ZUreP-2, preučena pa so tudi mnenja in predlogi zakonodajalca, ki jih je zapisal ob urejanju tvarine grajenega javnega dobrega. Ob tem so opisane tudi omejitve lastninske pravice na nepremičninah, institut služnosti v javno korist, pravica do zasebne lastnine po 33. členu Ustave Republike Slovenije (URS), vsebina lastninske pravice, ki jo ureja 67. člen URS, institut razlastitve, ki jo določa 69. člen URS in pojem razlaščujočih posegov, kot ga definira pravna teorija in sodna praksa. V nalogi so predstavljena tudi merila, po katerih se določa razlikovanje med javnim in zasebnim interesom glede omejitve lastninske pravice. Ugotovili smo, da je ohranitev razmejitve med socialno vezanostjo lastninske pravice (t.i. razlaščujoči posegi) in pravnim režimom razlastitve bistvena za sobivanje zasebnega in javnega interesa. Ohranjanje ravnovesja med premoženjsko svobodo posameznika in javnim interesom je ključna naloga zakonodajalca. Merilo med slednjima po katerem se mora ravnati zakonodajalec je vsebovano v načelu sorazmernosti, po katerem se je v sodni praksi izoblikoval test sorazmernosti.

Title:Build public good on personal property real estate
Abstract:According to the Law of Property Code, Public Good is something that anyone can use, in accordance with its purpose, under the same conditions. The status of Public Good is obtained solely based on a general or individual legal act. Article 19 of the Law of Property Code states that the Public Good is a real estate, which has been granted the status of Public Good by an appropriate legal act of the state or local community. The Spatial Management Act, which will become the main act for the regulation of the institution of built Public Good on 1 June 2018, brings a change to the legislation in the mentioned area. Thus, the main theme of this thesis – entitled Built Public Good on Personal Property Real Estate, is comparison between the provisions of the current Construction Act and the Spatial Management Act. The thesis also analyzes the opinions and proposals of the legislator, which were written when regulating the built Public Good. It also describes the restrictions of property rights in real estate, the easement service for public benefit, the right to private property defined by the Article 33 of the Constitution of the Republic of Slovenia, the content of the property right regulated by Article 67 of the Constitution, the institute of expropriation defined by the Article 69 of the Constitution and the concept of expropriation procedures, as defined by legal theory and case-law. The thesis also presents the criteria for determining the difference between public and private interests regarding restriction of property rights. Maintaining the differentiation between the social attachment of property rights (so-called 'expropriation procedures') and the legal expropriation arrangements is essential for the coexistence of private and public interests. Maintaining balance between the individual's freedom to property and the public interest is the legislators key task. The criteria to differentiate between the two and which the legislator must follow is included in the principle of proportionality, in accordance to which the proportionality test was established in the case-law.
