Title:Odgovornost za dogodke pred rojstvom otroka

Abstract:Magistrsko delo z naslovom Odgovornost za dogodke pred rojstvom otroka obravnava tematiko odgovornosti matere, zdravnika, babice in tretjih oseb za dogodke, ki se zgodijo, preden se otrok rodi. Rojstvo otroka za mati predstavlja neizmerno veselje in ponavadi je njena glavna želja, da se otrok rodi zdrav, zato se vzdrži določenih dejanj, ki bi mu lahko škodovala. Niso pa vse matere enake. Mati lahko s svojim ravnanjem že v času nosečnosti svojemu nerojenemu otroku škoduje. Uživanje alkohola, tobačnih izdelkov in drog negativno vpliva na fetus in lahko pusti trajne posledice. Magistrsko delo predstavi negativne učinke uživanja omenjenih substanc na fetus. Odgovornost matere za njena dejanja v Sloveniji, kjer mati med nosečnostjo ne odgovarja za svoja dejanja, primerja z odgovornostjo matere v Wisconsinu, na Irskem in Poljskem. V Wisconsinu fetus namreč velja za osebo že od spočetja, zato je mati zaradi uživanja substanc lahko priprta, poslana na prisilno zdravljenje ali ji je celo odvzeto skrbništvo nad fetusom. Na Poljskem mati sicer ne odgovarja za svoja dejanja med nosečnostjo, je pa njena pravica do splava zelo omejena. Pravica do splava je prav tako zelo omejena na Irskem, mati pa odgovarja, v kolikor povzroči smrt fetusa. Magistrsko delo obravnava tudi odgovornost zdravnika za dogodke pred rojstvom otroka. Zdravnik je lahko namreč v času nosečnosti malomaren in stori zdravniško napako. Zdravnik odgovarja moralno, disciplinsko, odškodninsko in kazensko. Enako odgovornost kot zdravnik za svoje delo prevzema tudi babica, saj lahko s svojimi dejanji prav tako škoduje fetusu. Obravnavana je še odgovornost tretjih oseb za dejanja, storjena pred rojstvom otroka. V Sloveniji tretje osebe ne odgovarjajo za svoja dejanja, saj otrok pravno sposobnost pridobi šele z rojstvom in zatorej zoper fetus niso mogoča kazniva dejanja. Fetus je varovan samo posredno preko telesa matere. Ureditev v Wisconsinu, na Irskem in Poljskem je drugačna, saj tam tretje osebe lahko odgovarjajo za dogodke pred rojstvom otroka.

Title:Liability for prenetal injury
Abstract:The Master Thesis "Liability for Prenatal Injury" discusses the topic of maternal and third party liability and liabilities of physicians and midwifes for prenatal injury. A child's birth brings great joy to the mother and usually it is her main wish for the child to be born healthy, which is why she refrains from certain acts during pregnancy that could harm its health. But not all mothers share the same view. A mother can harm her unborn child with her behaviour during pregnancy. Alcohol, tobacco and drug use has a negative impact on a fetus and can leave permanent damage. The thesis presents the negative effects of substance use on a fetus and how mothers are not held responsible for prenatal injury in Slovenia. It also compares Slovenian legislation with maternal liability acts from Wisconsin, Ireland and Poland. In Wisconsinu a fetus is considered a person from conception. Due to substance use a Winsconcin mother can therefore be imprisoned, sent to involuntary rehabilitation or even lose custody of her fetus. In Poland the mother is not held accountable for her actions during pregnancy, however, her right to abortion is restricted. The right to abortion is also limited in Ireland and the mother is held liable if she causes the death of her fetus. The thesis also discusses liabilities of physicians for prenatal injury. A physician can make a medical error due to malpractice and is subject to moral, disciplinary, restitutionary and criminal liability. The same liabilities apply to a midwife, whose actions can also harm a fetus. Lastly, the liability of third persons for their acts commited during a woman's pregnancy is presented. In Slovenia third persons are not held liable for prenatal injury, since a child gains legal capacity with birth and thus no criminal act can be made upon a fetus. A fetus is only indirectly protected through the body of the mother. The legislation in Wisconsin, Ireland and Poland differs, as third persons can be held liable for their acts commited during a woman's pregnancy.
