Title:Položaj dolžnika v izvršilnem postopku v luči primera Vaskrsić proti Sloveniji

Abstract:Izvršilni postopek je sodni nepravdni postopek, urejen v Zakonu o izvršbi in zavarovanju (ZIZ). Namen sodnega varstva v izvršilnem postopku je izvršitev materialnopravnih dajatvenih zahtevkov, ki so nastali na podlagi pravnomočne odločbe ali druge izvršljive listine. Avtor v magistrski nalogi na podlagi sodbe Vaskrsić proti Sloveniji predstavlja položaj dolžnika v izvršilnem postopku. V navedeni sodbi je Evropsko sodišče za človekove pravice ugotovilo, da so bili izvršilni ukrepi v postopku zoper Vaskrsića nesorazmerni glede na znesek dolga. Dolžnikova nepremičnina je bila kljub majhnem znesku dolga prodana na dražbi. Sicer veljavna domača zakonodaja izrecno ni nalagala izvršilnemu sodišču, da se odloči za blažje izvršilne ukrepe po uradni dolžnosti oziroma zavrne predlog upnika zaradi nesorazmernosti. Prav tako ni bil določen minimalni prag glede višine dolga, tako da se je lahko tudi majhen dolg izterjal s prodajo nepremičnine. Vendar bi morale po stališču Evropskega sodišča oblasti kljub temu skrbno in izrecno upoštevati druge primerne, vendar manj skrajne možnosti. Avtor uvodoma predstavi temeljne institute v izvršilnem postopku. Nato predstavi dejansko stanje omenjene zadeve, potek izvršilnih postopkov zoper Vaskrsića, pritožbenih postopkov, postopka pred Ustavnim sodiščem in Evropskim sodiščem za človekove pravice. Nadalje opiše vpliv omenjene sodbe na obstoječi pravni red. Ob tem raziskuje pravice in dolžnosti dolžnika in upnika, ki so jih imeli na voljo v času teka postopka zoper Vaskrsića. Prav tako opisuje novosti, ki jih je prinesla novela ZIZ-L. Nazadnje še opiše postopek izvršbe in položaj dolžnika v drugih pravnih redih ter strne mnenja pravnih strokovnjakov glede predhodne in nove ureditve položaja dolžnika v izvršilnem postopku, vse v luči zadeve Vaskrsić proti Sloveniji.

Title:The position of debtor in the legal execution procedure in the light of case Vaskrsić v. Slovenia
Abstract:Legal execution procedure is regulated in Zakon o izvršbi in zavarovanju. The porpuse of legal protection in execution procedure is execution of substantive legal claims, arising from legally valid decision or other executive document. Author in the master’s thesis is writing about Case Vaskrsić vs. Slovenia, which represents debtor’s position in execution procedure. European court of Human Rights had stated that the enforcement measures were disproportionate to the amount of debt. Debtor’s real estate was sold despite small amount of debt. The applicable domestic law did not demand to Court to decide for more proportionate enforcement measure or reject creditor’s proposal because of disproportionality. According to the European Court of Human Rights decision, the authorities should consider other appropriate and less extreme options. Author initially presents the basic institutes in the enforcement procedure. Then Author presents the actual state of the case and procedures before a domestic court. Furthermore, author is writing about impact of the judgement on the existing legal order, presents rights and duties of creditor and debtor at the time of Vaskrsić case and new legal order. Finally, author describes comparative legal rules (Germany and Croatia) and summarizes the opinions of legal experts about legal procedure in the light of the case Vaskrsić vs. Slovenia.
