Abstract:Magistrsko delo z naslovom »Ukinitev instituta preiskovalnega sodnika« temelji na zasnovi osnutka novo nastajajočega Zakona o kazenskem postopku ZKP-1. Razdeljena je na tri dele. Prvi del predstavlja spremembe pristojnosti tožilca in preiskovalnega sodnika v zgodovinskem razvoju kazenskega procesnega prava, temeljna načela kazenskega postopka, ki so najbolj relevantna za položaj tožilca in preiskovalnega sodnika ter pristojnosti in naloge, ki jih imata državni tožilec in preiskovalni sodnik po trenutno veljavnem Zakonu o kazenskem postopku ZKP-M. Drugi del predstavlja osnutek novega Zakona o kazenskem postopku. Predstavljeni so razlogi in povod za spremembo veljavnega Zakona o kazenskem postopku, pri čemer so izpostavljene kritike pravnikov, ki so opozarjali na to, da je trenutna zasnova Zakona o kazenskem postopku neustrezna in zastarela. V nadaljevanju so izpostavljeni razlogi za spremembo Zakona o kazenskem postopku, ki smo jih razdelili na razloge politično-družbene in pravno-sistematske narave. Vsaka sprememba Zakona pa s seboj prinese tudi posledice, ki lahko nastanejo ob sprejetju novega zakona. Te posledice smo opredelili kot pasivizacijo sodišča in aktivizacijo strank, kot ločenost preiskave med obrambo in tožilstvom, ustanovitev dokaznega prava kot garanta poštenosti postopka ter opredelitvijo zadnje posledice, ki predstavlja avtonomijo posameznika kot temeljno izhodišče novega kazenskega postopka. Nato smo v celoti predstavili osnutek novega Zakona o kazenskem postopku, ki smo ga razdelili na splošni del, preiskovalni postopek, vmesno fazo in fazo obtoževanja. V splošnem delu so predstavljene pravice oškodovanca, nov institut predobravnavnega sodnika ter določbe o pristojnosti in izločitvi. V preiskovalnem postopku smo izpostavili pristojnosti in naloge državnega tožilca, predobravnavnega tožilca in položaj obdolženca. Nato je opisana največja posebnost novega preiskovalnega postopka, to sta vmesna faza ter obtožni postopek s priznanjem krivde obdolženca. V tretjem in tako zadnjem delu magistrskega dela so z namenom primerjave opisani kazenskoprocesni postopki drugih držav s podobno ureditvijo, ki jo prinaša novela ZKP-1.

Title:The
Abstract:This master's thesis entitled “Abolition of the institution of the investigating judge” is based on the preliminary draft of the newly emerging Criminal Procedure Act (CPA-1) and is divided into three parts. The first part presents the changes of competencies of the prosecutor and the investigating judge in the context of historical development of the criminal procedure law, fundamental principles of criminal procedure which are the most relevant for the position of the prosecutor and investigating judge, and the competencies and tasks of the public prosecutor and investigating judge according to the currently valid Criminal Procedure Act (CPA-M). The second part of the thesis presents the draft of the new Criminal Procedure Act. It presents the reasons and the cause of changing the valid Criminal Procedure Act and highlights the criticism by solicitors who drew the attention to the fact that the current draft of the Act is inadequate and obsolete. In the following section of the thesis we exposed the reasons for the change of the Criminal Procedure Act which were divided by their politically-social and legally-systematic nature. Each change of the Act brings consequences, which may arise at the time of the adoption of the new Act. We defined these consequences as passivation of the Court and activation of parties, as separate investigation performed by the defence and the prosecution, and as establishment of the evidence law as the guarantor of the fairness of the procedure. We also defined the last consequence which represents individual's autonomy as the fundamental premise of the new criminal procedure. Later, we comprehensively presented the draft of the new Criminal Procedure Act divided into the general part, investigation procedure, intermediate stage and the accusation stage. The general part presents victim's rights, new institution of the pre-trial judge, and the rules on competence and disqualification. In the investigation procedure we exposed competencies and tasks of the public prosecutor and the pre-trial prosecutor and the position of the accused person. Then, we described the most distinctive features of the new investigation procedure, i.e. the intermediate stage and the accusation procedure with the admission of guilt by the accused person. For the purpose of comparison, the third and final part of the master's thesis describes the criminal procedural proceedings in other countries with arrangements similar to the arrangements provided by the amendment to the CPA-1.
