Abstract:
Članek se ukvarja z vprašanjem progresivnega razvoja in posebnosti diplomatskega prava. V njem se avtor osredotoča na vprašanje 42. člena Dunajske konvencije o diplomatskih odnosih (in povezanih členov) ter "pravnih praznin", ki se pojavljajo pri razumevanju določb tega (in povezanih členov). Temeljna ugotovitev avtorja je, da nekonsistentnosti v Dunajski konvenciji o diplomatskih odnosih niso odraz namenske relativizacije posamičnih določb mednarodnopravnega dokumenta, ampak bolj odsev varoval, ki so bile pridane k 42. členu te konvencije.

Title:
(Non)intentional inconsistencies in diplomatic law : the case of Vienna convention on diplomatic relations
Abstract:
The article focuses on the progressive development of the diplomatic law, with a special emphasis on Article 42 of the Vienna Convention on Diplomatic Relations. The key idea of the discussion is to present some inconsistencies of the Vienna Convention on Diplomatic Relations, linked to its Article 42. The author presents arguments that the existing inconsistencies are not "intentional" (a sort of relativisator of settled rules), and should rather be understood as another possible fuse to establish stable and cooperative diplomatic relations.
