Title:Nadomestno materinstvo in varstvo otrokovih koristi : komentar sodbe ESČP v zadevi Paradiso in Campanelli proti Italiji

Abstract:Nadomestno materinstvo predstavlja danes v mnogih državah občutljivo politično, družbeno in pravno temo, saj pomeni, včasih celo ultima ratio, možnost pridobitve otroka, ki ga pari niso mogli pridobiti po naravni poti. Države članice EU danes vodijo dokaj enotno politiko na tem področju ter prepovedujejo nadomestno materinstvo, vendar pa je npr. dovoljeno v posameznih državah ZDA, na Tajskem, Rusiji in Indiji, kamor odhajajo z namenom pridobitve otroka po poti nadomestnega materinstva tudi "evropski" pari. Nadomestno materinstvo pomeni danes še mnoga odprta pravna vprašanja, s katerimi se posledično ukvarjajo tako nacionalna sodišča kakor tudi ESČP in SEU (npr. zadevi C-363/12 in C-167/12). V pričujočem primeru Paradiso in Campanelli proti Italiji so se italijanska sodišča ukvarjala s problematiko veljavnosti posvojitve, izigranjem prava ter neskladnostjo z italijanskim javnim redom, zaradi česar je bil otrok nameravanim staršem odvzet. Zaradi takšne odločitve italijanskega sodišča je bila vložena pritožba na ESČP ter zatrjevana kršitev 8. člena EKČP. ESČP je ugotovilo kršitev, saj je potrdilo, da je med pritožnikoma in otrokom bilo vzpostavljeno de facto družinsko življenje, kljub pomanjkanju bioloških vezi. Priznana jima je bila odškodnina, a otrok jima ni bil vrnjen, zaradi česar sta se pritožila na Veliki senat ESČP.

Title:Surrogate motherhood and best interest of the child : commentary of the ECHR decision Paradiso and Comapnelli v. Italy
Abstract:Surrogacy is presenting today in many countries a sensitive political, social and legal issue, because it means, sometimes also an ultima ratio% the possibility of obtaining a child, that couples are not able to obtain in a natural way. EU member states conduct today the uniform policy in this area and prohibit surrogacy, however the surrogacy is allowed in USA, Thailand, Russia and India, where the "european" couples are travelling with the intention to obtain a child. Surrogacy is presenting today still many open legal questions, with which are subsequently engaged national courts as well also ECtHR and CJEU (for example in cases C-363/12 in C-167/12). In case, Paradiso in Campanelli v. Italiji, the Italian courts have been engaged with the issues of validity of adoption, circumvention of the law and of the non-compliance with Italian public policy, due to which the child was deprived from intended parents. Due to such decision of the Italian court, it was the filled the appeal to the ECtHR and alleged violation of article 8 of the ECHR. The ECtHR found a violation, since it has confirmed that between the applicants and the child have been established de facto family life, despite the lack of biological ties. The applicants were recognized the compensation, but the child was not returned to them. Due to such decision the applicants appeal to the Great Chamber of the ECtHR.
