Abstract:Diplomska naloga obravnava problematiko varstva in izvajanja pravic otrok migrantov ter skuša opredeliti v kakšni meri Evropsko sodišče za človekove pravice skrbi za pravičnost pri varovanju pravic ene najšibkejših skupin prebivalstva, kadar so jim le te kršene. V zadnjih letih je v evropski prostor prispelo ogromno številko migrantov zaradi vojne na Bližnjem Vzhodu. Tretjina migrantov je mladoletnih. Ti otroci so zaradi svojih travmatičnih izkušenj potrebni pomoči državnih in evropskih institucij. Predstavljen je primer Evropskega sodišča za človekove pravice, ki obravnava kršitev člena 3 Evropske konvencije o varstvu človekovih pravic glede nečloveškega in ponižujočega ravnanja z otroci migranti v centru za pridržanje v Bolgariji.

Title:S. F. and others v Bulgaria - meaning of the case in the field of protection of children's rights
Abstract:The dissertation examines children's rights issues, focusing on protection and enforcment of rights of migrant children. It also tries to define the efforts of the European Court of Human Rights in providing justice when the rights of migrant children are breached. In the last few years, numbers of migrants in Europe have increased because of war in the Middle East. Third of those migrants are minors. Migrant children are vulnerable because of their traumatic experiences in the war zone. National and European institutions should provide them with all the help they need to live a normal, fear-free life. The dissertation also presents a European Court of Human Rights case, discussing a breach of Article 3 of European Convention on Human Rights regarding inhumane and degrading treatment of migrant children in a detention centre in Bulgaria.
