Title:Otroška pornografija - opredelitev pojma in pravne dileme

Abstract:Diplomsko delo obravnava področje otroške pornografije in pravne dileme, ki se pojavljajo ob razlagi tega pojma. Otroška pornografija pomeni vsako gradivo, ki vizualno prikazuje otroka, realistične podobe otroka ali osebo, ki je videti kot otrok, v dejanskem ali simuliranem spolnem aktu ali prikazuje njegove spolne organe predvsem za spolne namene. V prvem delu obravnavam teoretične osnove, ki so potrebne za razumevanje otroške pornografije. Definiram pornografijo, otroka, otroško pornografijo ter navajam mednarodne in domače pravne dokumente. Opisani sta tudi temeljni dobrini, ki ju pravo priznava otrokom, in sicer pravica do spolne samoodločbe in pravica do telesne in spolne integritete ter omogočanje nemotenega razvoja otroka. V osrednjem delu se osredotočam na posebni veji otroške pornografije, psevdo-otroško in virtualno otroško pornografijo. Skupno jima je, da ne predstavljata resničnega otroka, temveč ustvarjenega s pomočjo računalniškega generiranja. Psevdo-otroška pornografija pa vsebuje tudi polnoletne osebe, ki po zunanjosti izgledajo kot otrok. V zadnjem delu preverjam postavljene hipoteze s tujo sodno prakso. Z navedbo resničnih primerov raziščem, kdaj se vizualno gradivo šteje za otroško pornografijo in katere kriterije uporabimo v primerih pravnih dilem. Ugotovim, da pravo dopušča inkriminacijo posebnih vej otroške pornografije.

Title:Child pornography - definition of the concept and legal dilemmas
Abstract:The final work deals with the field of child pornography and legal dilemmas that appear at interpretation of this concept. Child pornography means any material that visually depicts a child, the realistic images of a child, or a person who appears as a child, in a real or simulated sexual act, or portrays his sexual organs primarily for sexual purposes. In the first part of the diploma thesis, I discuss theoretical basics that are necessary for understanding child pornography. I define pornography, child, child pornography and I list international and domestic legal documents. Two children rights admitted by law, are also described, namely the right to sexual self-determination and the right to physical and sexual integrity and to enable the child to develop normally. In the central part, I focus on a special branches of child pornography, pseudo-child and virtual child pornography. They have one thing in common and that is they are not representing a real child, but created with the help of computer generation. Psevdo-child pornography also contains adult persons who look like a child on their external appearance. In the last part, I test the hypotheses stated in my diploma with foreign case law. By defining real legal cases, I investigate when visual materials become child pornography and which criteria are used in cases of legal dilemmas. I also find out that law allows incrimination of special branches of child pornography.
