Title:Postopek upniške prisilne poravnave v Sloveniji in primerjava z Irsko ter Srbijo

Abstract:Globalizacija posredno vpliva na večji pomen insolventnih postopkov. Dandanes se v gospodarstvu velik del podjetij sooča z odločitvijo, ali naj zaključi svoje poslovanje, ali pa poskuša rešiti svoj položaj in nadaljuje s poslovanjem, v upanju, da bo poplačalo svoje dolgove in posledično okrevalo. Za delovanje vsakega podjetja je potrebno veliko poguma, trdega dela in tveganja. Včasih pa se stvari ne odvijajo po načrtih, podjetje postane, zaradi različnih razlogov, plačilno nesposobno in poiskati je potrebno najboljšo rešitev med insolventnimi postopki. Za upravljanje dolga podjetja je na voljo kar nekaj možnosti, odločanje pa je odvisno od resnosti dolga. V magistrskem delu govorimo o prisilni poravnavi z vidika novodobne prakse. Lotimo se vprašanj o ukrepih upniške prisilne poravnave kot posebnega instituta in zaščite dolžnikov v le-tej. Prav tako skušamo ugotoviti kako druge države obravnavajo prisilno poravnavo na predlog upnikov in na kakšen način so le-te zaščitile svoje dolžnike.

Title:Creditors' Compulsory Settlement Procedure and Difference between Slovenia, Ireland and Serbia
Abstract:Globalisation has an indirect impact on the greater importance of insolvent procedures. A large proportion of companies are facing the decision to complete their operations nowadays, or to try to resolve their situation and continue their business, hoping to repay their debts and, as a result, recover. It takes a lot of courage, hard work and risk for each company to work things out. Sometimes things do not go as planned and for various reasons the company becomes insolvent and finds the best solution during insolvent procedures. There are quite a few options available to manage company's debt, depending on its severity. This Master thesis discuss the compulsory settlement seen through the modern practice. The questions about the measures of creditors of compulsory settlement as a special institute are being addressed as well as those regarding the protection of debtors in such procedure. Among others, I tried to determine how other countries deal with the forced settlement on the proposal of creditors and how they protect their debtors.
