Title:Prikrojevanje ponudb v postopkih javnega naročanja v konkurenčnem pravu EU

Abstract:Omejevanje konkurence in s tem kršitev pravil konkurenčnega prava je razširjeno tudi na področje prava javnega naročanja in lahko privzema različne oblike. V magistrskem delu je obravnavana ena najbolj razširjenih oblik zatiranja naravnega stanja konkurence v postopkih oddaje javnega naročila in sicer t. i. prikrojevanje ponudb (bid rigging). Prikrojevanje ponudb predstavlja obliko omejevalnega ravnanja podjetij (kartela), pri kateri podjetja medsebojno sodelujejo in izkrivljajo konkurenco pri predložitvi ponudb v postopkih javnega naročanja. Magistrsko delo preučuje interakcijo med konkurenčnim pravom in pravom javnega naročanja ter možne tehnike odkrivanja in preprečevanja pojava prikrojevanja ponudb. Avtorica ugotavlja, da je k tesnejši povezami med obravnavanima pravnima področjema, med drugim, močno pripomogla izrecna opredelitev načela konkurence v Direktivi 2014/24/EU o javnem naročanju. Postopki javnega naročanja so zaradi svojih eminentnih lastnosti še posebej izpostavljeni ravnanjem prikrojevanja ponudb. Eno temeljnih načel javnega naročanja je namreč načelo transparentnosti, ki ima pomembno vlogo pri preprečevanju koruptivnih dejanj, na drugi strani pa prav preglednost postopka povečuje možnosti, da bodo konkurenti potvarjali razpisne ponudbe in s tem izključili konkurenco na trgu. Pomembno je, da se vzpostavi ustrezno ravnovesje med transparentnostjo in preprečevanjem prikrojevanja ponudb, ki bo omogočalo optimalno izpolnjevanje tako ciljev prava javnega naročanja kot tudi ciljev konkurenčnega prava. Obenem nam spoznanja kažejo, da ima pri uspešnem odkrivanju in preprečevanju prikrojevanja ponudb najpomembnejšo vlogo naročnik v sodelovanju z organom za varstvo konkurence. Učinkovit boj zoper takšno kartelno delovanje je mogoče zagotoviti le, če se vzpostavi ustrezen mehanizem sodelovanja med akterji postopka javnega naročanja (naročniki in ponudniki) ter organi za varstvo konkurence. Nadalje, naročnike je potrebno glede odkrivanja in preprečevanja nedovoljenih praks prikrojevanja ponudb dodatno izobraziti, pri čemer so v veliko pomoč Smernice OECD za bojevanje proti dogovorjenemu oddajanju ponudb v javnih naročilih.

Title:Bid Rigging in Public Procurement Procedures in EU Competition Law
Abstract:Restriction of competition and therefore the breach of EU Competition Law is a widespread issue in the field of public procurement procedures and may appear in diferent forms. The thesis addresses the questions pertaining to one of the most widespread forms of restriction and distortion of the natural state of competition in public procurement procedures, which is the so-called bid rigging. Bid rigging represents a form of restrictive conduct, in which the companies cooperate and therefore distort the competition in the bid submission process of the public procurement procedures. The thesis analyses the interaction between the competition law and the law of public procurement procedures and possible techniques of discovering and preventing bid rigging. The author concludes that the bond between the analysed fields of law has been strenghteneg by the Directive 2014/24/EU on public procurement procedures which provides a specific definition of the competition principle. The bidding procedure of public procurement procedures are, due to its eminent qualities, especially prone to bid rigging conduct. One of the fundamental principles of public procurement is the principle of transparancy, which plays an important role in prevention of corrupt condcut, while also increasing the chances of the competitors' decision to rig their bids and therefore restrict and/or distort the competition on the market. It is important to establish a proper balance between transparency and preventing the bid rigging conduct in such a way, that the fulfilment of fundamental objectives of public procurement procedures may be possible, while also taking into consideration the objectives of the competition law. At the same time experiences show that the key to a successful detection and prevention of bid rigging is the role of a bidder in cooperation with the competition authorities. Efficient campaign against bid rigging may only be initiated when the proper mechanism of cooperation between the subjects of public procurement procedures (the bidders and the buyers) and the competition authorities is established. More so, the bidders have to be educated on the discovery and prevention of illegal practices of bid rigging, which may also be done by using the Recommendation of the OECD Council on Fighting Bid Rigging in Public Procurement.
