Title:Pomen načela omejenega kroga stvarnih pravic za razumevanje stvarnopravnih razmerij

Abstract:Magistrsko delo z naslovom Pomen načela omejenega kroga stvarnih pravic za razumevanje stvarnopravnih razmerij zajema opredelitev načela numerus clausus stvarnih pravic in drugih stvarnih načel, ki so z njim tesno povezana. V našem pravnem redu so stvarne pravice izključujoče in nastanejo samo po volji zakona in ne po volji posameznih subjektov. Njihova tipska prisila bistveno pripomore k varnosti pravnega prometa. Pravice stvarnega prava so določene v 2. členu Stvarnopravnega zakonika , pravna teorija pa jih razvršča v dve kategoriji. V prvo kategorijo spada lastninska pravica, kot temeljna pravica stvarnega prava. V drugo kategorijo se uvrščajo vse druge stvarne pravice, ki so izvedene iz lastninske pravice in jih poimenujemo stvarne pravice na tuji stvari ali omejene stvarne pravice. Te pravice so zastavna pravica, služnosti, pravica stvarnega bremena in stavbna pravica. Prav tako kot zakon določa omejeno število stvarnih pravic, pa je predpisana tudi njihova vsebina, ki je stranke prostovoljno ne morejo spreminjati. Bistvo magistrske naloge temelji na numerus clausus stvarnih pravic v širšem smislu, ki zajema kogentno določeno vsebino posameznih stvarnih pravic in pravni temelj nastanka, prenosa in prenehanja teh pravic. Najpomembnejša je lastninska pravica, saj se na podlagi 13. člena SPZ zakonska določila o lastninski pravici glede pridobitve, prenosa, varstva in njenega prenehanja, smiselno uporabljajo tudi za nastanek in prenos ostalih stvarnih pravic. Niso pa zakonska pravila za vse stvarne pravice določena v enakem obsegu in enako strogo, npr. pri služnosti in pravici stvarnega bremena se lahko njihova vsebina določi šele na podlagi konkretnega pravnega razmerja.

Title:The importance of the principle of a limited number of property rights for understanding the inherent relations in property law
Abstract:Master's thesis titled The importance of the principle of a limited number of property rights for understanding the inherent relations in property law includes the definition of the numerus clausus of property rights and other in rem principles, that are closely related to it. Rights in rem are in our legal order exclusive and occur only by the will of the law and not according to the will of the individual entities. Their obligatory framework significantly contributes to the safety of legal transactions. Rights of ius in re are set out in Article 2 of the Law of Property Code, legal theory, however, classifies them in two categories. In the first category belongs the property right as a fundamental right of property law. In the second category fall all other rights in rem, which derive from property rights and are called jus in re aliena or encumbrances. These rights are a lien, servitude, right of real burden and building title. As the law stipulates the number of property rights, it also prescribes their contents, so that they cannot be voluntarily changed by clients. The essence of the master's thesis is based on the "numerus clausus in a broad sense", which includes peremptory specific content of individual property rights and the legal foundation of creation, transfer and termination of these rights. The most important is the property right, since, on the basis of Article 13 of the Law of Property Code, statutory provisions on the property right regarding the acquisition, transfer, protection and termination apply mutatis mutandis also to the creation and transfer of other property rights. Not all statutory rules for all rights in rem are determined with the same strictness, e.g. the contents in the servitude and the right of real burden can be determined only on the basis of a concrete legal relationship.
