Title:Naloge in pooblastila slovenske policije na Slovenskem morju : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:druge varnostne organe velik izziv. Obravnavani problem v diplomskem delu temelji na pomorski policiji, njihovih izzivih in pooblastilih, ki jih imajo. Analizirali smo Zakon o nalogah in pooblastilih policije, ki je eden izmed osnovnih zakonov o delu in pooblastilih policije. Na podlagi analiz drugih zakonov smo bolj podrobno raziskali pooblastila, ki jih ima pomorska policija. Slovenska policija ima za nadzor državne meje na morju in nadzor nad dogajanjem na teritorialnem morju na razpolago plovila, helikopterje ali druge tehnične pripomočke. Pomorski policiji so v pomoč pri nadzoru dogodkov na morju tudi inšpekcijske službe, Slovenska vojska, carina in druge državne institucije. Najbolj kritično območje slovenskega morja zagotovo predstavlja Piranski zaliv. V Piranskem zalivu se nahaja morska meja med Slovenijo in Hrvaško. Meja med obema državama ni bila nikoli natančno določena. Velika prelomnica in tudi nov izziv se je zgodil s sprejemom arbitražne razsodbe med Slovenijo in Hrvaško iz junija, leta 2017. Pred arbitražno razsodbo je meja v Piranskem zalivu potekala po sredini. Arbitražna razsodba je spremenila državno mejo v prid Sloveniji tako, da je Slovenija dobila večinski del Piranskega zaliva. Hrvaška se z odločitvijo ni strinjala in je začela kršiti arbitražno razsodbo. Ribiška in policijska plovila so na ilegalen način pričela s prehodi državne meje, saj so Hrvati zanikali novo določeno mejo. Pomorska policija je zato postavljena pred zahtevno nalogo, in sicer na kakšen način zagotoviti in pravilno uporabiti policijska pooblastila za uveljavljanje arbitražne razsodbe. V diplomskem delu so predstavljeni primeri iz medijev, ki prikazujejo delovanje pomorske policije in uporabo pooblastil pri kršenju arbitražne razsodbe.

Title:Tasks and powers of the slovenian police in the slovenian sea
Abstract:The Republic of Slovenia is located in the central part of Europe, which means that Slovenia represents the crossroads of the transition from the southern to the northern part of Europe. It is important to mention the Slovenian sea. The position of the Slovenian sea is favorable for the conversion of goods from the Adriatic Sea to the Pannonian Plain. The good geographical position of Slovenia represents a great challenge for police and other security authorities. The problem discussed in the diploma work is based on the maritime police, their challenges and the powers they have. We have analyzed the Police Tasks and Powers Act, which is one of the basic laws on the work and powers of the police. On the basis of analysis of other laws, we have studied more closely the powers of the maritime police. The Slovenian police have vessels, helicopters or other technical devices available for the control of the state border at sea and control of events on the territorial sea. The maritime police are also assisted in the monitoring of events at sea, including inspection services, Slovene army, customs and other state institutions. The most critical area of the Slovenian sea is certainly the Piran Bay. In the Piran Bay there is a sea border between Slovenia and Croatia. The border between the two countries has never been precisely defined. A major turning point, and also a new challenge, took place with the acceptance of the arbitration agreement between Slovenia and Croatia in June 2017. Before the arbitration agreement, the border in the Piran Bay was held in the middle. The arbitration agreement changed the state border in favor of Slovenia by giving Slovenia a majority share of the Piran Bay. Croatia did not agree with the decision and started the violation of the arbitration agreement. Fishing and police vessels started illegally crossing the state border, as Croats denied the new limit. The maritime police are therefore faced with a demanding task, namely how to ensure and properly use the police powers to enforce the arbitration agreement. The final thesis presents examples from the media that show the functioning of the maritime police and the use of powers in violation of the arbitration agreement.
