Title:Nasilje v družini - statistična obravnava kaznivega dejanja in neučinkovitost kazni pri preprečevanju nasilja : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Skozi zgodovino vidimo, da je bilo nasilno vedenje do otrok tolerirano, takšno vedenje je bilo za otroka zelo pogosto, skoraj vsak dan. Takrat so poznali otroške bordele, posledično so morali sprejeti zakon, ki je šolam zapovedoval zapiranje pred sončnim zahodom. Na ta način so vzgojitelji zaščitili otroke pred zlorabo učiteljev. Leta 1874 je v New Yorku prvo spodbudo za ureditev starševskih dolžnosti podalo združenje za preprečevanje trpinčenja živali (Society for Prevention of Cruety to animals) (Domiter, 2014). Naša zakonodaja je glede oblike pregona sledila zgledom iz tujine, najbolj dosledno se izražajo ZDA, predvsem v obvezni aretaciji povzročitelja nasilja. Dosledno se izražajo tudi pri uvedbi pravila, da mora tožilec uvesti pregon, saj je to v njegovi dolžnosti in ga ne sme opustiti, tudi če mu žrtev nasprotuje ali postane med postopkom pasivna. Slovensko kazensko pravo je preko oblikovanja novega kaznivega dejanja, v katerem so zajete lažje oblike nasilja v družini, ki se preganja po uradni dolžnosti. Žrtvam je omejilo možnost vplivanja na začetek in potek kazenskega postopka zoper nasilneža (Dvoršek in Selinšek, 2010). V diplomskem delu bom opravila statistični pregled kaznivega dejanja nasilja v družini v razponu od leta 2008 do leta 2016. Pogledali bomo, ali je število prijav skozi leta upadlo ali naraslo.

Title:Family abuse - statistical treatment of criminal act and inefficency of penalties in the prevention of violence
Abstract:Throughout history we have witnessed the tolerance of violence against children. Brutal beatings and paedophilia were all part of the culturally accepted abuse children had to endure in the past (e.g. exorcism of the devil form the child). In his research De Maus found documents dating back to ancient Greece and Rome which showed the daily abuses a child would face. Most of the abuse would be in form of sexual abuse (brothels which offered the “rent a boy” service or the Greek mentorship program where adult men would “help” young boys transition into adulthood). In light of these problems laws had to be implemented which demanded that schools be closed before sunset to prevent the teachers for abusing their students in any form (Domiter, 2014). Our own legislation on this matter followed good examples from abroad. The commitment of a state towards the prosecution of those accused of such abuse, is best shown in the US. Their commitment is best shown in the fact that accused has to be arrested and a legal procedure must be started against him by the prosecutor, even if the victim does not wish to press charges or becomes passive during the procedure (also known as the “no drop policy”). When it comes to facing family abuse Slovenian law took some of the power from the victims in regards to starting and the development of the procedure toward their abuser. This was managed through the formation of procedures that cover even the lightest form of abuse (Dvoršek in Selinšek, 2010). Through this thesis I will examine the statistics on reported crimes connected to family abuse between 2007 and 2016. I will focus on determining if there was a rise or decline when it comes to the question of family abuse.
