Title:Verodostojno pričanje otrok in starostnikov : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Otroci in starostniki se pogosto pojavljajo v vlogi priče, pa tudi kot žrtve kaznivih dejanj, zaradi pomankanja materialnih dokazov pa velikokrat predstavljajo edini vir informacij, zato je njihovo pričanje izjemnega pomena. Otroci in starejše priče so pogosto obravnavani kot nezanesljive priče, saj se pojavljajo dvomi o njihovih sposobnostih za pričanje. Ta ranljivejša skupina oseb velja za neverodostojno zaradi slabših spominskih in zaznavnih sposobnosti ter skromnejšega priklica podatkov. Diplomska naloga opisuje otrokove in starostnikove sposobnosti za pričanje, značilnosti razvojnih obdobij otroka in pozne odraslosti ter vpliv dejavnikov, ki med opazovanjem dogodka in zaslišanjem vplivajo na verodostojno pričanje. Namen je bil ugotoviti, ali so otroci in starostniki lahko verodostojne priče, v kolikšni meri je njihova sposobnost za pričanje odvisna od načina spraševanja preiskovalcev ter kako staranje in z njim povezan upad fizičnih in psihičnih funkcij vpliva na pričanje. Raziskave so pokazale, da so otroci in starostniki lahko verodostojne priče. Staranje sicer lahko v določenih okoliščinah negativno vpliva na pričanje, prav tako tudi otrokov še nerazvit kognitivni sistem, vendar je njihova verodostojnost in zanesljivost odgovorov v veliki meri odvisna od načina spraševanja preiskovalcev in uporabe izpraševalnih tehnik. Uporaba sugestivnih vprašanj ima na otroke in starejše priče nedvomno večji vpliv kot na mlajšo odraslo generacijo, vendar se tudi stopnja sugestibilnosti razlikuje pri vsakem posamezniku drugače, zato ne moremo prav vse otroke in starostnike obravnavati kot bolj sugestibilne.

Title:Reliable testimony of children and the elderly
Abstract:Children and the elderly frequently appear in the role of witnesses, as well as victims of various punishable acts, but for the lack of material evidence they in many cases represent the only source of information, so their testimony is exceedingly important. Children and the elderly are frequently deemed unreliable witnesses, as doubts arise about their ability to testify. This more vulnerable group of individuals are known as unreliable for lack of memory capability, perceptual abilities and weakened retrieval of data. The thesis describes the child's and the elder's ability to testify, characteristics of the developmental periods of childhood and late adulthood and the factors, which influence the reliable testimony during the observation of the event and during the interrogation. The purpose was to determine whether children and the elderly can be credible witnesses, to what extent their ability to testify depends on the method of questioning investigators, and how aging and the associated decline in physical and psychological functions influence the testimony. Research has shown that children and the elderly are credible witnesses. Aging in some cases has a negative impact on the testimony, as well as a child’s undeveloped cognitive system, but their reliability and credibility of responses largely depend on the method of questioning investigators and the use of interrogation techniques. The use of suggestive questions has undoubtedly a greater influence on children and older people than on the younger adult generation, but the degree of suggestibility differs in each individual, therefore, we cannot treat all children and the elderly as more suggestible.
