Title:Razvoj, uporaba in prihodnost PEACE modela preiskovalnega intervjuja : magistrsko delo

Abstract:Glede preiskovalnega intervjuja se pojavlja vprašanje o problematiki dobre prakse. Posledice izvedbe preiskovalnega intervjuja se kažejo na pravosodnem, kazenskem, postopkovnem ter celo političnem in socialnem področju. V slabih primerih se lahko sčasoma izkaže, da so bile osebe po krivem obtožene. To se je v veliko primerih zgodilo v Angliji, kjer so na slab način reševali primere bombnih napadov teroristične skupine IRA. Po krivem obsojene ljudi so morali osvoboditi iz zaporov in preprečiti nadaljnje sodne zmote. Te napake so v sistemu pustile veliko sled, ki se je širila tudi v nezaupanje ljudi v pravosodni sistem in vlado. Sčasoma so posledično v Angliji na podlagi raziskav o spominu razvili tehniko PEACE preiskovalnega intervjuja in jo implementirali v sistem. Potem se je tehnika razvila v tujini, med drugim na Norveškem, kjer je njena uporaba prinesla vzorno razrešitev znanega primera terorističnega napada, ki ga je izvedel Anders Behring Breivik. V tem je vidna velika razlika, ki jo je prinesel preskok iz starega načina izvedbe preiskovalnega intervjuja. Dobro izveden proces preiskovanja dogodkov pomeni pravično obravnavo in izid za vse vpletene: osumljence, priče in žrtve. Preiskovalci, ki izvajajo preiskovalne intervjuje, se morajo zavedati, kako pomembno je ohraniti neobtožujoče mišljenje o osebi, s katero opravljajo intervju. Ta miselnost je namreč ključna za zbiranje informacij o preiskovanem dogodku. Na ta način, ko se preiskovalci takoj izognejo domnevi o krivdi intervjuvanca, bodo zbrali največ informacij, za katere bodo lahko trdili, da so tudi verodostojne. Tehnika PEACE je resda dovršena, vendar bi si preiskovalci želeli lažjo in dostopnejšo izvedbo, ki bi proces predvsem skrajšala. V tem se kaže, da je tehnika kljub že odličnim rezultatom še vedno odprta za manjše izboljšave.

Title:The development, use and future direction of peace model of investigative interviewing
Abstract:Concerning investigative interviewing, there has been an issue raised regarding good practice. The consequences of carrying out investigative interviews are reflected in the judicial, criminal, procedural, and even political and social spheres. In poor cases, it can eventually prove that people have been wrongfully accused. This happened in England when several cases of the IRA bombings were dealt with in a poor way. According to the situation, the convicts had to be pardoned and released from prisons and further judicial errors had to be prevented. These errors affected the system in such a way that it caused the distrust of people in the judicial system and even the government itself. On the basis of memory research, England eventually developed the PEACE investigation technique and implemented it into the system. Further, the technique began to spread abroad widely, including to Norway where its use brought to an exemplary resolution of the well-known case of the terrorist attack as perpetrated by Anders Behring Breivik. Evidently, there came to be a big difference which was brought about by the leap from the old ways of conducting investigative interviews. A well-executed process of investigating events means a just treatment and outcome for everyone involved: suspects, witnesses, and victims. Investigators carrying out interviews should be aware of the importance of maintaining a non-accusing mindset about the person they interview. Such a mindset is crucial for collecting information about the event that is investigated. When investigators immediately avoid the assumption of guilt, they collect the most information that they can claim to be credible. Of course, the PEACE technique is complete. However, the investigators’ wish is for a simpler and more accessible use that would shorten the process. This shows that the technique is still open for minor improvements despite the excellent results.
