Title:Kartelni sporazumi — analiza novejših primerov iz evropske in slovenske prakse

Abstract:Dandanes je svobodni trg glavni dejavnik razvoja družb in doseganja ekonomske učinkovitosti. Kartelni sporazumi posegajo v delovanje prostega trga, saj negativno vplivajo na potrošnike in konkurenco ter zavirajo družbeno rast. Karteli so v skladu s konkurenčnim pravom strogo prepovedani, oblasti pa se že mnogo let trudijo razbiti nedovoljene zdužbe. V diplomskem projektu se dotaknemo omejevalnih sporazumov, jih umestimo v konkurenčno pravo Evropske unije in Republike Slovenije ter jih podrobneje razčlenimo. V sklopu sporazumov obravnavamo vertikalne in horizontalne dogovore med konkurenti, k slednjim uvrščamo tudi kartele. Preučujemo jih tako na območju Evropske unije, kot tudi v Sloveniji. Pojavljajo se v obeh okoljih, preganjajo pa jih pristojni organi za varstvo konkurence. Poleg konkurenčnopravnega vidika, kartele opredelimo še iz ekonomskega stališča. Analiziramo praktične primere kartelov v Evropski uniji in Sloveniji ter višine dodeljenih glob, po obravnavnih primerih kartelizacije pa podamo še komentar o kartelnih praksah. Začetno zastavljeni hipotezi tekom diplomskega projekta potrdimo. Prva se navezuje na usklajenost zakonodaj s konkurenčnopravnega vidika, druga pa na višine dodeljenih glob s strani varuhov konkurence.

Title:Cartel agreements — analysis of recent cases from European and Slovenian practice
Abstract:Nowadays, the free market is a major factor in the development of companies and the achievement of economic efficiency. Cartel agreements interfere with the functioning of the free market by negatively affecting consumers and competition and inhibiting social growth. Cartels are strictly forbidden under competition law, and the authorities have been trying for many years to break illicit licenses. In the diploma we discuss restrictive agreements, place them in the competition law of the European Union and the Republic of Slovenia and analyze them in detail. As part of the agreements, we deal with vertical and horizontal agreements between competitors, including cartels. We study them both in the European Union and in Slovenia. They occur in both environments and are prosecuted by the Competition Authorities. In addition to the competitive and legal aspects, we define cartels from an economic point of view. We analyze practical cases of cartels in the European Union and Slovenia, the level of fines they are assigned and after considering the cases of cartelization, we also provide commentary on cartel practices. The initial hypotheses during the diploma are confirmed. The first relates to the harmonization of legislation from a competitive point of view, and the second relates to the amount of fines assigned by the Competition Authorities.
