Title:Varstvo otrokovih pravic v digitalnem okolju : magistrsko delo

Abstract:Magistrsko delo obravnava precej moderno tematiko, tj. novodobni – digitalni svet. V povezavi s tem se v delu osredotočamo na raznorazne kršitve, ki jih uporaba moderne tehnologije prinaša, predvsem za otroke in mladostnike, katerih uporaba tovrstne tehnologije iz leta v leto vedno bolj narašča. S strani raznoraznih raziskav je nesporno dokazno, da današnja mladina svoj prosti čas preživlja drugače, kot je to bilo še pred desetletji, ko digitalizacije še ni bilo na razpolago oziroma vsaj ne v tolikšni meri. Posledično uporabi, pa se porast kršenja pravic otrok veča. Za dosledno razumevanje tematike magistrske naloge smo na začetku razdelali in pojasnili osnovne pojme, predvsem kaj digitalno okolje sploh pomeni in kaj vse zajema. Ugotoviti je bilo potrebno tudi, nosilci katerih vseh pravic otroci sploh so in izhajajoč iz tega, katere od slednjih so največkrat tarča kršitev s strani dejanj storjenih v digitalnem okolju. Po raziskovanju, katere pravice otrokom pripadajo, je bilo moč ugotoviti, da so pravice otrok urejene v širokem pravnem obsegu, kar zajema zakonodajo tako na ravni EU kot tudi v domači zakonodaji. Iz pregleda le-te smo spoznali, da je možnosti za kršitev teh pravic v digitalnem okolju ogromno, zato je zelo pomembno, da je to pravno področje dodobra urejeno. Najpogostejše oblike kršitev, ki se na internetu pojavljajo predstavljajo pornografija, pedofilija in kibernetsko nasilje, tj. nasilje povzročeno preko digitalne tehnologije.

Title:Protection of children´s rights in the digital environment
Abstract:The master’s thesis examines a modern subject matter – a present-day digital environment – – and various violations of laws and rules which is enabled by the use of modern technology; especially, in the younger generation of children and minors whose use of the modern technology increases every year. Various researches indisputably prove that the free time of youth is spent differently today as it was decades ago when the digitalization was not at hand at such extent as today, or at all. Furthermore, as the usage of digitalization increases, so does the violation of children’s rights. For better understanding of the topic, we first introduce and explain basic concepts, especially the meaning and range of the digital environment. We establish what rights do children have and which of those rights are violated the most in the actions taken in the digital environment. Children’s rights are settled in a very wide legal range, which includes the European Union legislation as well as Slovenian legislation. The violation of children’s rights in the digital environment is extremely large; therefore, it is important that the legal system concerning those rights is well established. Most frequent forms of violations that appear on the internet are pornography, paedophilia, and cybernetic violence i.e. the violence caused by using electronic means
