Abstract:Alternativne oblike reševanja kazenskega postopka predstavljajo izjemo od načela legalitete. Za njihovo uporabo se po lastni oceni odloči državni tožilec, nadaljnji postopek pa je odvisen od sodelovanja oškodovanca in obdolženca ali od volje sodišča, ki preverja formalne in materialne predpostavke. Poznamo dve taki obliki: popolno ukinitev kazenskega postopka in delno ukinitev kazenskega postopka. Pri prvi sploh ne pride do formalnega kazenskega postopka, saj se konča z zavrženjem ovadbe. Sem spadajo opustitev kazenskega pregona, poravnavanje in pogojno odložen kazenski pregon. Pri delni ukinitvi kazenskega postopka pa postopek poteka brez glavne obravnave, konča pa se z obsodilno sodbo. Takšna instituta sta sporazum o priznavanju krivde in kaznovalni nalog. V diplomski nalogi so s pomočjo analize poročil državnih tožilstev predstavljeni posamezni instituti in njihova uporaba v praksi.

Title:Alternative dispute resolution (adr) in criminal procedure
Abstract:Alternative dispute resolotion in criminal procedure are an exception from the principle of legality. They are used based on the assessment of a public prosecutor, while the procedure itself depends on the cooperation of the injured party and the suspect or the will of the court that verifies the formal and material pre-conditions. Two such alternative forms exist: complete termination of criminal proceedings and partial termination of criminal proceedings. The first one does not include a formal criminal proceeding due to the fact that charges are dismissed. This includes suspension of prosecution, settlement and conditional discontinuance of prosecution. Partial termination of criminal proceedings includes proceedings without the principal action that result in conviction. Such constructs include admission of guilt agreement and penal order. Using an analysis of public prosecutors 'offices' reports, this diploma thesis presents the individual constructs and their use in practice.
