Title:Območja rdečih luči v Belgiji : magistrsko delo

Abstract:Belgijska zakonodaja samo dejavnost, kot tudi kupovanje storitev prostitucije, dovoljuje, vendar vpletanje tretjih oseb, kot so zvodniki ali upravljalci javnih hiš, prepoveduje. Vendar mestnim oblastem prepuščajo, da to določbo obidejo, kadar zadeva javni red in mir. To pomeni, da zvodništvo in vodenje javnih hiš v večini primerov ni preganjano, čeprav je na nacionalni ravni prepovedano, vendar se tolerira, kadar so pogoji v redu. Zakonodaja tako za tretje osebe, ki niso nujno negativni dejavnik v prostituciji, saj so mišljeni kot posredniki, ki vodijo gospodarsko dejavnost prostitucije, ustvari veliko nejasnosti. Prav tako pride na zakonodajni ravni do pogostega prekrivanja med definicijama izkoriščanja prostitucije in trgovine z ljudmi, kar še dodatno zmanjša pravno varnost oseb, ki so vključene v prostitucijo. V Belgiji imajo mestne oblasti različne ureditve prostitucije, ki so razvidne predvsem v ureditvi njihovih območij rdečih luči. V našem primeru smo opisali in primerjali območja rdečih luči Antwerpa, Genta in Bruslja. Med bolje organizirana območja sodita Antwerp in Gent, medtem ko je tisto v Bruslju slabše organizirano. V luči tega v magistrskem delu ugotavljamo, kako določena ureditev območja rdečih luči vpliva na nadzor nad izkoriščanjem prostitucije, prisotnost policije na območju, vpletenosti tretjih oseb, delovnih pogojev za spolne delavke, drugih organizacij, ki delujejo na območju, ter tudi kakšno pomoč se spolnim delavkam nudi, kadar so prepoznane kot žrtve trgovine z ljudmi, ali ko izrazijo željo po zapustitvi dejavnosti prostitucije.

Title:Red light districts in belgium
Abstract:Belgian legislation allows prostitution and buying services of prostitution, but prohibits third-party involvement, such as pimping or operating a brothel. However, the municipalities are allowed to circumvent this provision when it concerns public order. This means that in most cases pimping or operating a brothel is not persecuted, even though it is prohibited on the national level, however it is tolerated if the conditions are acceptable. The law thus creates a lot of ambiguity for third parties, which are not necessarily meant as a negative factor in prostitution, as they are mostly meant as intermidiaries leading the economic activity of prostitution. Furthermore, there is a frequent overlap between the definitions of the exploitation of prostitution and trafficking in human beings, which further adds to the lack of legal certainty of persons involved in prostitution. Belgian cities have different arrangements of prostitution, which are evident in the regulation of their red light districts. In our case, we have described and compared red light districts of Antwerp, Gent and Brussels. Antwerp and Gent are among better organized red light districts, while Brussels is organized worse. This masters's thesis examines how different settings of red light districts affects the control over the exploitation of prostitution, the presence of the police, third-party involvement, working conditions for sex workers, other organizations operating in the area, and also what kind of assistance is offered to sex workers, when they are recognized as victims of human trafficking, or when they express their desire to leave the prostitution.
