Title:(Ne)spoštovanje mednarodne arbitražne odločbe : diplomsko delo

Abstract:Konvencija o mirnem reševanju mednarodnih sporov države podpisnice v primeru spora napotuje na različne oblike mirnega reševanja sporov med drugim tudi na arbitražo. Uradno je Stalno arbitražno sodišče v Haagu nastalo z 20. členom omenjene konvencije, ki določa, da se sile podpisnice obvezujejo, da bodo organizirale Stalno arbitražno sodišče, ki bo vselej dostopno in bo delovalo v skladu s pravili postopka, vključenimi v to konvencijo, razen če se stranke dogovorijo drugače. Stranke spora izbirajo člane arbitraže iz spiska arbitrov, lahko pa imenujejo tudi druge posameznike. Odločitev arbitražnega sodišča je tako odločitev večine arbitrov, ki je dokončna in zavezujoča tako da pritožba ni več mogoča. Kadar so v sporu države, zanje ne velja imuniteta pred izvršitvijo odločbe. Kadar pride do dokončne odločitve arbitražnega sodišča, morajo države kot stranke spora določbe iz arbitražne odločbe implementirati v nacionalni pravni red. Težava pa se pojavi, ko država tega ne stori, saj v mednarodnem pravnem okolju ni sistema prisile, ki bi se izvajal v primeru nespoštovanja takih odločb. Problematika neizvršitve arbitražne odločbe je v diplomski nalogi izpostavljena v dveh sporih in sicer pri mejnem sporu med Slovenijo in Hrvaško ter Filipini in Kitajsko glede Južnokitajskega morja.

Title:Ignored international arbitration award
Abstract:The purpose of the Convention for the Pacific Settlement of International Disputes is that the international disputes should be resolved through peaceful means. One of those ways is to solve a dispute in the Permanent Court of Arbitration in Hague which was officialiy organised under article 20 of the mentioned Convention. The article stipulates that with the object of faciliating an immediate recourse to arbitration for international differences, which has not been possible to settle by diplomacy, the Signatory Powers undertake to organize a permanent Court of Arbitration, accessible at all times and operating, unless otherwise stipulated by the parties. The parties of a dispute select the arbitrators from the list or they can select other individuals to take part. The final decision is made by the majority of arbitrators and is final and binding, so that the appeal is not possible anymore. When the states are the only parties the immunity from enforcement is not possible. When the arbitration award becomes binding, the states have to implement it into their national legal system. When the state fails to enforce the arbitration award the problem arises, because there is no system that would force the states to do so. In the diploma thesis the problem of failure to enforce the arbitration award is presented through two border disputes between Slovenia and Croatia and between Philippines and China.
