Title:Zaslišanje otrok: značilnosti otrok, priporočila in izvedba : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:V 80ih letih prejšnjega stoletja se je začelo obravnavati zaslišanja otrok in sodelovanja otrok v kazenskih postopkih kot problematično. Širiti se je začelo zavedanje, da so otroci veliko bolj kompetentne priče, kot se jim je v preteklosti pripisovalo, da pa je potrebno sodne postopke prilagoditi otrokom. Ko je otrok poklican na zaslišanje je predvidoma že doživel, bodisi kot priča, oškodovanec ali storilec, nek travmatičen dogodek. Vsako podoživljanje tega dogodka, za otroka predstavlja dodaten stres. Doživeti stres, slabše spominske in sporazumevalne sposobnosti otrok, večja dovzetnost za sugestije in druge značilnosti otrok, so pomembni dejavniki, ki jih je potrebno upoštevati pri zasliševanju, ki hkrati niso razlog za diskreditacijo otroka kot priče. Veljavnost in vrednost otrokovih izjav je v veliki meri odvisna od sposobnosti in usposobljenosti izpraševalca. Diplomska naloga se osredotoča na otroke v zgodnjem otroštvu in pregleda bistvene značilnosti razvoja otrok, ki vplivajo na izvedbo zaslišanja. Poznavanje teh značilnosti je ključnega pomena za uspešno zaslišanje. Diplomska naloga poda pregled priporočil strokovnjakov za otrokom prijazno pravosodje, ki sledijo interesom otrokovih pravic in verodostojnosti kazenskih postopkov. Analiza primera prikaže korektno izvedeno zaslišanje otroka vključno z uporabo Griffithsove sheme vprašanj za ocenjevanje v zaslišanju uporabljenih vprašanj. Glavna omejitev je nedostopnost slovenskih sodnih spisov, ki bi omogočili vpogled v prakso zaslišanja otrok v Sloveniji.

Title:Child interrogation: characteristics of children, ecommendations and execution
Abstract:In the 1980s the interrogation of children and their cooperation in criminal procedures begun to be treated as problematic. The awareness that children are a lot more competent witnesses then it was believed in the past started spreading, but that the litigation to be adapted to them. When the child has been summoned to participate in criminal procedures the assumption is that it has already lived, seen, been victim or the cause of a traumatic event. Every reliving of the traumatic event constitutes additional stress for the child. The trauma, lower memory and communicative abilities, higher susceptibility to suggestion and other characteristics of children are important factors that need to be considerate during interrogation and are not reasons for discreditation of the child as a witness. The validity and value of the child's statement depends greatly on the ability and competence of the interrogator. The dissertation focuses on children in the early stages of childhood and overview of vital characteristics of the child's development that affect the process of the interrogation. Understanding these characteristics is key for a successful interrogation. The dissertation offers a review of experts recommendations on child-friendly criminal procedures, that follow the interest of children's rights and credibility of criminal trials. Case analysis shows the properly executed interrogation of a child including the use of the Griffiths Question Map for evaluating questions used in the interrogation. The main limitation is the inaccessibility of Slovenian court records, that would allow insight into child interrogation practice in Slovenia.
