Abstract:	V diplomski nalogi je predstavljen morski datelj, ki ga je bilo, zaradi iztrebljanja, potrebno z zakonodajo nujno zaščiti. Ekstremne metode, kot je razstreljevanje morskih balvan, ki se jih pri iskanju in nabiranju morskih datljev poslužujejo kriminalci, uničujejo celoten morski ekosistem. Zaradi vse večjega povpraševanja po prostoživečih živalih in rastlinah (v našem primeru morskega datlja) pa je poleg morskega ekosistema, ogroženih tudi vse več živalskih in rastlinskih vrst. Z vse večjo globalizacijo se je pojavila velika potreba po sodelovanju med tujimi varnostnimi organi in drugimi organi tujih držav. Pri mednarodnem policijskem sodelovanju seveda ne gre pozabiti na usklajene operativne akcije in koordinacijske sestanke med državami, saj zgolj z izmenjavo informacij ne bi prišli do želenih ciljev. Za zmanjšanje tihotapstva datljev bi bila nujno potrebna sprememba zakonodaje in strožja kaznovalna politika v Republiki Sloveniji ter še več aktivnosti tako represivnih organov, kot tudi ozaveščanje gostincev in končnih potrošnikov. Iz intervjujev z okrožno državno tožilko in ribiškim inšpektorjem namreč izhaja, da je zavedanje pomena ohranjanja zaščitenosti morskega datlja in ničelna toleranca do tovrstne problematike v Republiki Sloveniji slaba oziroma na nizkem nivoju. Za uspešnejše preiskovanje problematike ekološke kriminalitete, v našem primeru tihotapljenja morskih datljev, bi bila nujno potrebna sprememba nacionalne zakonodaje, ki bi dovoljevala uporabo vseh prikritih preiskovalnih ukrepov, saj se storilci na lahke načine organizirajo v kriminalne združbe in okoriščajo z večjimi vsotami denarja, s tem pa je preiskovanje tovrstne problematike za policiste in kriminaliste še dodatno oteženo. Posledično zaradi premalo pridobljenih dokazov tudi tožilstvo ne more zahtevati in predlagati najstrožjih obsodb storilcem kaznivih dejanj. Brez dobrih odnosov med varnostnimi in sodnimi organi sosednjih držav pa je preiskovanje tihotapstva morskega datlja skoraj nemogoče.

Title:	Criminal aspects of data mussels smuggling
Abstract:	In the diploma the date mussel is presented, which had to be protected by legislation, since it is almost extermined. Extreme methods, such as blasting marine boulders, used by criminals to find and collect date mussels, are destroying the entire marine ecosystem. Due to the increasing demand for wildlife (in our case, the date mussel), in addition to the marine ecosystem, more and more species are endangered. With the increasing globalization, there exists a great need for cooperation between foreign security authorities and other authorities of foreign countries. International police cooperation should also include coordinated operational actions and coordination meetings between countries, since the sole exchange of information would not achieve the desired goals. To reduce the smugling of date mussels a change in legislation would be required along with a stricter penal policy in the Republic of Slovenia, as well as more activities by repressive authorities. Furthermore raising awareness of caterers and consumers would be of great help. Interviews with the District Attorney General and the Fishery Inspector have revealed that the awareness of the importance of maintaining date mussels as a protected species and zero tolerance of such problems in the Republic of Slovenia is not sufficient. To gain success in investigations regarding environmental crimes, in our case of date mussels smuggling, a change in national law that would involve permitting the use of all covert investigative measures would be required, since the perpetrators can easily organize themselves into criminal organizations and gain great benefit including larger sums of money, which in turn makes investigating this kind of problems even more difficult for police officers and detectives. Consequently, due to insufficient evidence, the prosecution is unable to seek and propose the most stringent convictions for offenders. Therefore, without good relations between the security and judicial authorities of neighboring countries, it is almost impossible to investigate date mussels smuggling.
