Title:Prelivanje premoženjskih kategorij zakoncev, zunajzakonskih partnerjev ter partnerjev v partnerski zvezi na podlagi aktualne sodne prakse : magistrsko delo

Abstract:Premoženjska razmerja med zakonci (v nadaljevanju z njimi izenačenimi zunajzakonskimi partnerji ter partnerji v partnerski zvezi) so kompleksne narave, saj v času trajanja partnerske skupnosti prihaja do številnih prelivanj premoženjskih kategorij, skupnega ter posebnega premoženja. Že na začetku je potrebno opozoriti, da skupno premoženje sestavljajo premoženjske pravice, ki so bile pridobljene z delom ali odplačno med trajanjem zakonske zveze, medtem ko posebno premoženje lahko opredelimo kot premoženje, ki ga je zakonec pridobil pred sklenitvijo zakonske zveze ali neodplačno med trajanjem zakonske zveze. Dandanes so mladi zaradi finančne negotovosti postavljeni v položaj, ko živijo doma ter tako vlagajo sredstva in delo v premoženje, ki je v lasti staršev ali tretjih oseb. Posledično prihaja do številnih prelivanj premoženjskih kategorij ter vlaganj, predvsem posebnega premoženja enega zakonca v posebno premoženje drugega zakonca, vlaganja skupnega premoženja v posebno premoženje, podjetniškega vlaganja ter drugih primerov, ki imajo za posledico vzpostavitev stvarnopravnih ter obligacijskih učinkov. Po pravilih obligacijskega prava ima zakonec, ki vlaga, splošni verzijski zahtevek, pravila stvarnega prava pa kot izhodišče napotujejo na uporabo pravil 48. člena SPZ, ki graditelju ne priznava lastninske pravice, temveč zahtevek za povrnitev tistega, za kar je bil lastnik obogaten. Ob tem se pojavljajo številna vprašanja v zvezi z zahtevkom, ki zakoncu pripada na podlagi vlaganj, za kar se je povečala vrednost nepremičnine. Gre predvsem za vprašanja, od koga lahko zakonec zahteva nazaj tisto, kar je vložil, v kakšnem času ter kakšnem obsegu. Med drugim pravila Družinskega zakonika glede premoženjskih razmerij med zakonci posegajo na področje vlaganj zakoncev, saj v primeru, če zakonec vlaga delo ali sredstva v nepremičnino, ki je posebno premoženje drugega zakonca, se lahko zakonca sporazumeta o obstoju in višini ter zavarovanju terjatve, ob upoštevanju pravil stvarnega prava ter zakona, ki ureja izvršbo in zavarovanje. Prav tako imata zakonca po novi ureditvi precej več možnosti v primeru izločitvene pravice v postopku osebnega stečaja enega izmed njiju. S sprejetjem Družinskega zakonika je bil odpravljen kogentni, sicer veljavni zakoniti premoženjski režim in po novem imata zakonca možnost sklenitve pogodbe o ureditvi premoženjskopravnih razmerij ter svobodno ureditev premoženjskega režima. S sklenitvijo omenjene pogodbe, pa se pojavljajo številna vprašanja, predvsem glede publicitetnega učinka registra pogodb o ureditvi premoženjskopravnih razmerij ter dolžnosti in skrbnosti tretjih oseb o stanju vpisov, ki izhajajo iz registra, glede nadrejenosti ter podrejenosti premoženjskega statusa partnerjev. Ugotovimo lahko, kako pomembna je ureditev premoženjskega režima v času trajanja partnerske skupnosti, da kasneje, predvsem ob razvezi, ne prihaja do problemov ter s tem povezanimi postopki.

Title:Transfer of property categories of spouses and partners in civil relationships based on current case law
Abstract:Property relationships between spouses (hereinafter also encompassing partners in civil relationships as equal under the law) are complex, as there are numerous transfers of property categories, both separate and community property, during the course of the partnership. It is important to note at the outset that community property consists of earnings and property rights acquired against repayment during marriage, while separate property can be defined as property acquired by the spouse prior to marriage or free of repayment during marriage. Due to financial insecurity, young people are nowadays often forced to live at home and invest resources and work in property owned by parents or third parties. As a result, there are a number of transfers of property categories and investments, in particular of separate property of one spouse to separate property of the other spouse, investment of community property in separate property, entrepreneurial investments and other cases giving rise to effects under law of property and law of obligations. According to the law of obligations, the investing spouse has a general indemnification claim, whereas as a starting point, the rules of property law refer to the application of the rules laid out in Article 48 of the Law of Property Code, under which the person building the property does not have property rights, but a claim for repayment of assets invested to the benefit of the owner. This raises a number of questions regarding the claim rights of the spouse on the basis of investments which have increased property value. These questions mainly refer to the following: from whom can the spouse claim the return of invested assets, in what timeframe in to what extent? Among other, the field of spousal investments is affected by the rules of the Family Code regarding property relations between spouses, since in case one of the spouses invests work or assets in a property considered as separate property of the other spouse, the spouses may agree on the existence and amount and insurance of the claim, taking into account the rules of property law and the law governing enforcement and insurance. The adoption of the Family Code abolished the mandatory, otherwise valid property regime as prescribed by the law; now spouses have the option to conclude a contract on the regulation of property relations and free regulation of the property regime. The conclusion of the aforementioned contracts gives rise to a number of questions, in particular regarding the publicity effect of the registry of contracts on the regulation of property relations and the duties and due diligence of third parties related to the status of registry entries regarding the superiority and inferiority of the partners' property status etc. Under the new arrangement, spouses also have significantly more options in the event of a right of exclusion in the process of personal bankruptcy of one of the spouses. It can be concluded that it is important to lay down the property regime during the marriage, so that later, particularly in case of divorce, no problems and related procedures arise.
