Abstract:Namen prispevka: Namen prispevka je pregled kriminoloških in pravnih vidikov vzpostavitve javno-zasebnega partnerstva na področju izvrševanja kazenskih sankcij. Metode: Raziskovalni pristop oziroma metode v prispevku so kombinacija pravnih metod jezikovne in teleološke razlage veljavne ureditve RS in EU v kombinaciji s pregledom kriminološko-penoloških del ter analizo in sintezo, ki je podana v razpravi na koncu prispevka. Pregled je narejen na podlagi komparativne analize penoloških študij o učinkih javno-zasebnega partnerstva glede izvrševanja kazni zapora in kvalitativne-pravne analize »de lege lata« slovenske zakonodaje, ki ureja javno-zasebno partnerstvo. Ugotovitve: Javno-zasebno partnerstvo pomeni, da država ali lokalna skupnost sklene dolgoročno pogodbo za zagotavljanje blaga in storitev z zasebnim partnerjem, zasebni partner pa je odgovoren za izgradnjo, upravljanje in vzdrževanje infrastrukture, ki je za to potrebna. Javno-zasebno partnerstvo pri upravljanju zaporov v drugih državah s temi izkušnjami ne pomeni ravno poslabšanja zadev s kriminološkega in penološkega vidika, saj so rezultati študij na področju zasebnih zaporov različni. V Sloveniji je pravno okolje primerno za testno vzpostavitev javno-zasebnega instituta v praksi, vendar bo uspešnost tega pristopa razvidna šele v prihodnje, po pridobljenih prvih izkušnjah. Izvirnost/pomembnost prispevka: Članek s kombinacijo pravne, penološke in kriminološke analize in sinteze prispeva k prihodnjim razmišljanjem o možnostih reševanja problema prezasedenosti zaporov v Republiki Sloveniji. V članku je razdelana ena od možnih alternativ, to je vzpostavitev javno-zasebnega zapora. V primerjalnem pregledu so prikazane nekatere izkušnje v drugih državah in nekatere misli teoretikov s tega področja. Morda bo članek koristen v nadaljnjem razmišljanju o alternativnih rešitvah sedanje prezasedenosti zaporov v Sloveniji.

Title:Criminological and legal aspects of possibilities for public-private partnerships for enforcement of prison sanctions in the Republic of Slovenia
Abstract:Purpose: The purpose of this paper is to examine and present an overview of criminological and legal aspects related to the establishment of public-private partnerships for enforcement of criminal sanctions. Design/Methods/Approach: The overview is based on a comparative analysis of criminological-penological studies focussing on the effects of public-private partnerships in the field of enforcing prison sentences and a qualitative legal analysis of the applicable (de lege lata) Slovene legislation governing public-private partnerships. The research approach/method applied in this paper represents a combination of legal methods consisting of a teleological interpretation of the existing Slovene and EU legislations and an overview of criminological works in this field, followed by an analysis and synthesis provided in the discussion section at the end of the paper. Findings: Public-private partnership means that the State or local community concludes a long-term contract for the supply of goods and services with a private partner who is, in turn, responsible for construction, management, and maintenance of the infrastructure necessary for providing the goods and services concerned. When applied to the management of prisons, experiences of other countries show that public-private partnerships do not necessarily lead to deterioration of matters from the criminological point of view, since the results of studies in the field of private prisons vary. In Slovenia, the legal environment is suitable for establishing a pilot public-private institution in practice, but the success of such an approach will only become clear in the future, i.e., after gaining initial experience. Originality/Value: By combining legal and criminological analysis and synthesis, this paper contributes to further reflections regarding different possibilities for resolving the issue of overcrowded prisons in the Republic of Slovenia. It also elaborates on one of the potential alternatives, i.e., establishment of a public-private prison. The comparative overview demonstrates certain experiences from other countries and some reflections of theoreticians in this field. The paper may also prove useful for any further considerations regarding alternative solutions for resolving the current prison overcrowding in Slovenia.
