Abstract:	Namen prispevka: V besedilu je predstavljena problematika policijske diskrecije kot enega najbolj kompleksnih pojavov v odnosu policije do prava in prav tako kot enega največjih izzivov, ki se kaže kot zahteva po legalnosti policijske dejavnosti in vladavine prava nasploh. Primarno so zajeta naslednja vprašanja: kaj je policijska diskrecija, ali je dovoljena, v kakšnem obsegu je dovoljena, kateri so dejavniki, ki vplivajo na izvajanje policijske diskrecije in sprejemanje odločitev, ter problematika nadzora. Predstavljeni so najpomembnejši rezultati študij policijske diskrecije, posebna pozornost je namenjena tudi študijam primerov, ko v določenih situacijah policija ni uporabila pravnih sredstev, tudi če so bili izpolnjeni vsi zakonski pogoji. Metodologija: Prispevek je zasnovan na podlagi analize strokovne literature (še posebej britanske in ameriške) in na analizi rezultatov tujih raziskav tovrstne problematike. Ugotovitve: Obstoj policijske diskrecije predstavlja eno najbolj kompleksnih vprašanj odnosa policije do vladavine prava. Izsiliti diskrecijska pooblastila ne samo, da ni mogoče, ampak je tudi nepotrebno. Na odločitve policistov vplivajo številni nepravni dejavniki, ki se jih moramo dobro zavedati. Tudi samo pravo dovoljuje policiji, skozi institut diskrecijske pravice, fleksibilno uporabo zakona. Policijski poklic zahteva delo z ljudmi in v trenutku, ko se policist sooči z državljani, ima možnost sprejemanja diskrecijskih odločitev. V tem trenutku preneha mehanična uporaba zakona in policist ima priložnost, da na podlagi svoje osebne ocene odloči, na kakšen način in s kakšnimi sredstvi bo razrešil konkreten primer. Pri diskrecijskem odločanju je potrebno poskrbeti za ustrezno rabo. Izvirnost/pomembnost prispevka: Izvirna vrednost prispevka je vidna v celovitem pravno-sociološkem pristopu k analizi problema policijske diskrecije v kontekstu koncepta vladavine prava. V prispevku so poudarjeni osnovni načini, s katerimi je možno policijsko diskrecijo ustrezno nadzirati in uporabljati.

Title:	Police Discretion in the Context of the Anglo-American Tradition of the Rule of Law
Abstract:	Purpose: The main aim of the article is to highlight the problem of police discretion as one of the most complex facts of the police attitude toward the rule of law as well as one of the biggest challenges, that is seen as a requirement for the legality of policing and as a requirement for the rule of law in general. The article is focused on the main results from the studies on police discretion, and the following questions are emphasized: what is the police discretion, is it permitted or not and if yes to what extent, what are the facts that affect the implementation of police discretion, who does the decision making and who is responsible for the control over the police discretion. Special attention is also devoted to the case studies of the non-use of the legislation despite the legal conditions were created. Design/Methodology/Approach: The article is manly based on the analysis of the British and American literature and on the police discretion research reports. Findings: The police discretion represents one of the most complex issues of the police attitude toward the rule of law. It is not possible to force the usage of police discretion, neither is it necessary. We are aware of many non-legal factors that affect police decisions. Jurisprudence itself allows flexible usage of the legislation through the discretion rights. The police profession includes working with the human beings and discretionary decision-making could occur whenever police is dealing with the citizens. At that very point, the mechanical application of the legislation ceases and the police officer has the possibility to make decision on how and by what means to resolve a concrete issue, manly on his personal estimation. In exercising law enforcement powers it is necessary to provide a proper usage of discretion. Originality/Value: The original value of the article is in a comprehensive legal and sociological problem-analysis approach to the police discretion. The focus of the article is on the basic methods of the proper police discretion control and its proper usage.
