Title:Psihične posledice po krivem zaprtih oseb : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:V zaključnem delu so predstavljene psihične posledice ljudi, ki so bili obsojeni zločina, ki ga niso storili, in so po nedolžnem morali prestajati zaporno kazen. Podrobneje so opisane psihične posledice, ki so se začele pojavljati ob aretaciji oziroma ko so nedolžno osebo označili za osumljeno, in se potem te posledice vzdržujejo v času, preživetem v zaporu. Te posledice pa ne izginejo ob dokazani nedolžnosti, vendar lahko osebo spremljajo še vrsto let. Med opisanimi psihičnimi posledicami so posttravmatska stresna motnja, depresija in anksioznost. Posttravmatska stresna motnja je psihična motnja, ki se lahko razvije, ko oseba doživi stresen dogodek, lahko je tako fizično kot psihično neobičajen dogodek, ki ga oseba ni pričakovala v svojem življenju. Tako kot za posttravmatsko stresno motnjo je tudi za depresijo značilno, da jo sproži neprijeten dogodek. Ob tem pa je za depresijo značilno še, da se pojavi ob izgubi pomembne osebe. Nedolžno obsojeni so prisiljeni zapustiti svoje domove in iti v zapor, s čimer na neki način izgubijo svoje bližnje. Za zadnjo pogosto motnjo, anksioznost, ki se pojavi ob krivi obsodbi, je značilno, da se sproži ob prisotnosti ponavljajočega se stresa in ob travmatični izkušnji. Kako pa pride do napačne obsodbe? Vzrokov za to je več. V zaključnem delu so opisane napake, kot so napake očividcev, lažna priznanja, pritiski skupnosti, slaba pomoč odvetnikov in predznanje o kazenski evidenci, ki jo vodijo ali pa pripomorejo k napačni obsodbi. Predstavljene pa so tudi organizacije, ki skrbijo, da se odkrije resnica o nedolžnosti osebe, ob tem pa se jim nudi pomoč ob izpustitvi, da lahko ponovno zaživijo svoje življenje.

Title:Psychological consequences on the unjustly imprisoned persons
Abstract:In my thesis the psychological consequences on people convicted of crime they had not committed and were unjustly forced to serve the prison sentence are presented. Psychological consequences which started appearing at the moment of arrest or when the innocent person was identified as a suspect and then continue throughout the time of imprisonment are described in detail. However, these consequences do not disappear when the person is proven innocent, but can accompany the person for many years that follow. Among the described psychological consequences there are the post-traumatic stress disorder, which can develop when the person experiences a stressful event, it can be either a physically or psychologically unusual event which the person did not expect in their lives. As for the post-traumatic stress disorder it is also typical of depression that it is triggered by an unpleasant event. What is typical of depression as well is that it can appear after the loss of an important person. Wrongly convicted persons are forced to leave their homes and go to a prison, whereby in some way they lose their loved ones. For the last common disorder, anxiety, which appears after the conviction of a crime they had not committed, it is typical that it is triggered by an ongoing stress and a traumatic experience. How does a wrong conviction occur? There are many reasons. In the final part the mistakes, such as witness’s mistakes, false confessions, community pressure, poor help of the lawyers and the lack of knowledge of the criminal record can all lead or contribute to a wrong conviction. Organisations which make sure that the truth about the innocence of a person is discovered and which also help them to start living their lives fully after the release are also introduced.
