Abstract:V diplomskem delu predstavljamo primerjavo nacionalne poklicne kvalifikacije vojaka in policista. Sodelovanje Slovenske vojske in slovenske policije ni nič tujega, leta 2015 pa je sodelovanje postalo še tesnejše. Migrantsko-begunski prehod čez južno mejo Slovenije je Vlado Republike Slovenije in Državni zbor Republike Slovenije prisilil, da premislita o zapisanem v 37. členu Zakona o obrambi, in sicer da pripadniki Slovenske vojske pri opravljanju nalog, ki jih opravljajo v sodelovanju s Policijo, pri varovanju državne meje nimajo policijskih pooblastil. Tako je državni zbor 21. 10. 2015 sprejel Zakon o dopolnitvi Zakona o obrambi, s katerim so pripadniki Slovenske vojske dobili nova izjemna pooblastila vojske. Vojaki Slovenske vojske tako lahko ob uveljavitvi sklepa o izvajanju izjemnih pooblastil vojske v sodelovanju s Policijo opozarjajo, napotujejo, začasno omejujejo gibanje oseb in sodelujejo pri obvladovanju skupin in množic. Namen primerjave nacionalnega poklicnega standarda vojaka in policista je bil ugotoviti, ali so vojaki Slovenske vojske usposobljeni za izvajanje izjemnih pooblastil vojske, ki v osnovi veljajo za policiste slovenske policije. Rezultati primerjave so pokazali, da med poklicnima standardoma vojaka in policista obstajajo razlike in to na najbolj pomembnem področju operativnega dela. Razlike med standardoma kažejo na to, da vojaki Slovenske vojske niso usposobljeni za izvajanje pooblastil, ki v osnovi veljajo za policiste, čeprav jih potrebujejo za pomoč Policiji pri širšem varovanju državne meje.

Title:Comparison of the national professional qualifications of a soldier and a police officer within the meaning of article 37.a of the defense law
Abstract:This paper compares national professional qualifications for soldiers and police officers. The Slovenian Police and the Slovenian Army had cooperated for a long time and in 2015 their cooperation even strengthened. Due to migrants and refugees crossing the south Slovenian border, the government of the Republic of Slovenia and the Slovenian National Assembly were forced to revise Article 37 of the Defence Act, stating that the members of the Slovenian Army cannot exercise police powers, despite cooperating with the Slovenian Police, when performing tasks related to the state border protection. On 21 October 2015, the Slovenian National Assembly adopted the Act Amending the Defence Act, ensuring members of the Slovenian Army new exceptional powers. When the decision on the Army’s exercise of exceptional powers comes into force, the soldiers of the Slovenian Army can, in cooperation with the Slovenian Police, warn and direct people, temporarily restrict their movement and participate in crowd control. The aim of the comparison of national professional standards for soldiers and police officers was to determine whether members of the Slovenian Army are qualified for the exercise of exceptional powers of the Slovenian Army, which fundamentally apply to police officers of the Slovenian Police. The results of the comparison showed that there are differences between professional standards for soldiers and police officers, especially in the most important field of operative work. The differences between the standards show that the soldiers of the Slovenian Army are not qualified for the exercise of powers, fundamentally applying to police officers, even though they require these qualifications to assist the Slovenian Police in state border protection.
