Title:Aktivna evtanazija in pogoji za njeno upravičenost : diplomsko delo univerzitetnega študijskega programa Varstvoslovje

Abstract:Evtanazija se je prvič pojavila v antični Grčiji, kjer je pomenila dobro smrt. Tekom zgodovine se je pomen tega termina nenehno spreminjal, vse do danes, ko se ga je oprijel tako negativen prizvok, da se mnogi sprašujejo celo o njegovi dopustnosti. Aktivna evtanazija pomeni končanje človeškega življenja z namenom, da se ga odreši muk in trpljenja. Mnogi jo zamenjujejo s terminom samomor z zdravniško pomočjo, pri čemer gre za sorodno dejanje, ki se od aktivne evtanazije razlikuje zgolj v osebi, ki opravi usodno dejanje – pri evtanaziji je to zdravnik. Na svetu obstaja zgolj šest držav, ki so se do aktivne evtanazije opredelile pozitivno in jo legalizirale. To so: Nizozemska, Belgija, Luksemburg, Kolumbija, Kanada in Japonska. Ugotovili pa smo, da je bilo največ primerov evtanaziranj na Nizozemskem. Vsaka izmed njih predpisuje pogoje, ki so taksativno našteti, da se aktivna evtanazija lahko izvede brez, da bi zdravnikovo dejanje postalo protipravno. Pogoj, da mora biti oseba neozdravljivo bolna, da lahko zaprosi za evtanazijo, ni univerzalen kot smo predvidevali, še več, naša predvidevanja, da so pogoji v evropskih državah strožji kot drugje po svetu, so se izkazala za napačna. Samomor z zdravniško pomočjo se je najbolj razmahnil v ZDA, kjer je trenutno legaliziran v desetih zveznih državah. Prav tako sta dve zvezni državi Avstralije v svojo zakonodajo sprejeli zakona, ki dopuščata izvajanje zdravniške pomoči pri samomoru. V Evropi pa je dovoljen v Nemčiji in Švici, prav slednji pa se očita izvajanje »samomorilskega turizma«, kar pomeni, da so lahko tam evtanazirani tudi tujci. Slovenija ima do aktivne evtanazije in samomora z zdravniško pomočjo izrazito negativen odnos, saj že v Ustavi RS zakonodajalec predpiše, da se v človekovo življenje ne sme posegati.

Title:Active euthanasia and its eligibility criteria
Abstract:Euthanasia first appeared in Ancient Greece where it meant »good death«. Meaning of the term has changed throughout the history multiple times, until today, when many people are questioning themselves about its admissibility. Active euthanasia means ending human life with intention to release someone from pain and suffering. Many people mistake it with physician assisted suicide which is related to euthanasia but is not the same. The difference is in person who makes final act – in euthanasia case this person is a doctor. There are only 6 countries on the world, which legalised active euthanasia. Those countries are the Netherlands, Belgium, Luxembourg, Colombia, Canada and Japan. We found out, that most euthanasia cases out of those countries took place in the Netherlands. Every country has its own requirements which must be completed for lawful performance of active euthanasia. Under those requirements physician act is not contrary to the law. Incurable medical condition is not universal requirement as we thought, furthermore we assumed that eligibility criteria for active euthanasia is stricter in Europe than in other countries but that indicated as wrong. Physician assisted suicide mostly developed in USA where is currently legalised in 10 federal states. Australia also adopted the law that made physician assisted suicide legal in two federal states. In Europe is legalised in Germany and Switzerland where “suicide tourism” is reproached. Reason for this is the fact that foreign people can get medication for suicide too. Slovenia has distinctively negative attitude towards active euthanasia and physician assisted suicide since there is prohibition of interference in human life written in the constitution.
