Title:Pravni vidiki pri delu strokovnih delavcev v vrtcu

Abstract:Zakonodaja na področju vzgoje in izobraževanja v predšolskem obdobju zajema več področij. Strokovni delavci v vrtcu se z zakonodajo na tem področju dnevno srečujejo. Vsak profil zaposlenega strokovnega delavca, se srečuje z določeno zakonodajo. Zaključno delo predstavlja analizo zakonov, aktov, pravilnikov in priporočil stroke. Zavedamo se, da strokovni delavci v vrtcu niso podkovani z znanjem iz prava, zato je to zaključno delo pregled in analiza zakonodaje, s katero se vede ali nevede srečujemo pri delu v vrtcu. Zakon o vrtcih in Zakon o organizaciji in financiranju vzgoje in izobraževanja sta krovna zakona, na podlagi katerih se določa delo v vrtcu. Poleg teh dveh zakonov pa je potrebno poznavanje Konvencije o otrokovih pravicah, saj so otroci in njihova dobrobit naše glavno poslanstvo. Konvencijo o otrokovih pravicah je sprejela Organizacija združenih narodov in jo je ratificirala tudi Slovenija. Če želi občina ustanoviti vrtec, mora poleg Zakona o vrtcih in Zakona o organizaciji in financiranju vzgoje in izobraževanja upoštevati še ostalo zakonodajo. To so Zakon o zavodih, Pravilnik o normativih za opravljanje dejavnosti predšolske vzgoje, Pravilnik o normativih in minimalnih tehničnih pogojih za prostor in opremo vrtca. Vrtec nato potrebuje zaposlene in pri tem je treba upoštevati Zakon o javnih uslužbencih, Zakon o varstvu pred diskriminacijo in prej našteta pravilnika in zakone. Ko ima vrtec zaposlene, morajo strokovni delavci upoštevati poleg že naštete zakonodaje še: Zakon o varnosti in zdravju pri delu, Zakon o nalezljivih boleznih, Zakon o preprečevanju nasilja v družini, Zakon o varstvu osebnih podatkov, Pravilnik o zbiranju in varstvu osebnih podatkov na področju predšolske vzgoje, Pravilnik o dokumentaciji v vrtcu, Družinski zakonik, Zakon o celostni zgodnji obravnavi predšolskih otrok s posebnimi potrebami, Zakon o usmerjanju otrok s posebnimi potrebami, razne akte ter pravila in dogovore, ki jih sprejme posamezni vrtec.

Title:Legal aspects in the work of kindergarten practitioners
Abstract:Legislation in the field of pre-school care and education covers several areas. Kindergarten professionals are faced with legislation in this area on a daily basis. Each profile of an employed professional is subject to specific legislation. The Dissertation presents an analysis of laws, acts, regulations and recommendations of the profession. We are aware that kindergarten professionals are not well versed in the knowledge of law, so this dissertation is a review and analysis of the legislation that we knowingly or unknowingly encounter when working in a kindergarten. The Kindergartens Act and the Organization and Financing of Education Act are the framework laws on the basis of which work in a kindergarten is determined. In addition to these two laws, knowledge of the Convention on the Rights of the Child is required, as children and their well-being are our main mission. The Convention on the Rights of the Child was adopted by the United Nations and ratified by Slovenia. If a municipality wishes to establish a kindergarten, it must comply with other legislation in addition to the Kindergartens Act and the Organization and Financing of Education Act. These are the Institutions Act, Rules on norms for performing pre-school education activities, the Rules on norms and minimum technical conditions for the space and equipment of kindergartens. The kindergarten then needs employees, where the Civil Servants Act, the Prevention of Discrimination Act and the above-mentioned rules and laws must be taken into account. When a kindergarten has employees, professionals must comply with the following in addition to the legislation already listed; Occupational Safety and Health Act, Infectious Diseases Act, Family Violence Act, Personal Data Protection Act, Rules on the Collection and Protection of Personal Data in the Field of Pre-school Education, Rules on Kindergarten Documentation, Family Code, Integrated Law Act Early Treatment of Pre-school Children with Special Needs, the Orientation of Children with Special Needs Act, various acts and rules and agreements adopted by individual kindergartens.
