Title:Druga priložnost za podjetnika

Abstract:Podjetništvo je tvegan proces. Ustanavljanje podjetij, njihovi uspehi in neuspehi so del tržnega gospodarstva. V Evropi vsako leto cca. 200.000 podjetij doživi stečaj. Neuspeh podjetnika ne pomeni zanj konca ampak lahko pomeni začetek nečesa novega. Ko oseba doživi neuspeh in zapre svoje podjetje, ima možnost kadarkoli ustanoviti novo podjetje in začeti znova. To je druga priložnost za podjetnika. Javnost velikokrat stečaj povezuje z goljufijo in gleda nanj kot na kaznivo dejanje. V praksi pa je goljufivih podjetnikov le majhen odstotek. Ker pa mnenje družbe na ljudi močno vpliva, se nekateri podjetniki ne odločijo za drugo priložnost. Obstaja več dejavnikov, ki vplivajo na to ali se podjetnik odloči ponovno ustanoviti podjetje ali ne. Diferenciacija med poštenimi in nepoštenimi oziroma goljufivimi podjetniki je ključnega pomena za drugo priložnost. Povzeli smo študije raziskovalcev o stečaju in drugi priložnosti na ravni Evropske unije in naredili primerjavo posameznih evropskih držav. Kateri pogoji morajo biti izpolnjeni, da lahko začnemo znova, kakšni so postopki, stroški, zakonodaja, kdo je vključen v postopek itn. Na kratko smo navedli tudi, kako na drugo priložnost gledajo v Združenih državah Amerike. Za podjetnike v stečaju bi morali biti na voljo dobri podporni sistemi, tako psihološki kot tudi poslovni. Za lažji drugi začetek je tako pomembna podpora družine in bljižnjih ter stik z ljudmi, ki so postopek stečaja že »preživeli« in imajo izkušnje, kakor tudi dobri pravni sistemi, da s čim manj obveznostmi podjetnik reši postopek zaprtja in lažje pristopi k drugi priložnosti. Ohranjanje podjetnikov v naši družbi je ključnega pomena za napredek, gospodarsko rast in razvoj ter uspešnost države.

Title:Second chance for entrepreneur
Abstract:Entrepreneurship is a risky process. Founding a company and their successes and failures are a part of the market economy. In Europe, approx. 200,000 companies go bankrupt every year. The failure of an entrepreneur does not mean the end for him. Instead, it can mean the beginning of something new. When a person experiences failure and closes his business, he has the opportunity to found a new company at any time and to start again. This is the second chance for an entrepreneur. The public often associates bankruptcy with fraud and views it as a crime. In practice, however, only a small percentage of entrepreneurs are fraudulent. Because society’s opinion strongly influences people, however, some entrepreneurs do not opt for the second opportunity. Several factors influence whether an entrepreneur decides to re-establish a company or not. Differentiation between honest and dishonest or fraudulent entrepreneurs is essential for the second chance. We summarized researchers' studies on bankruptcy and the second chance on the European Union level and made a comparison of individual EU member states. What conditions must be met to be able to start again? What are the procedures, costs, and legislation? Who is involved in the process? And so on. We also outlined briefly how the second chance is viewed in the United States. Good support systems, both psychological and business, should be available for bankrupt entrepreneurs. To facilitate the second start, the support of the family and the loved ones is important, as well as the contact with people who have already "survived" the bankruptcy process and have the experience. Good legal systems are also very important so that the entrepreneur can solve the closure process with as few obligations as possible and access the second chance in the easiest possible way. Keeping entrepreneurs in our society is essential for progress, economic growth, and the development and the success of the country.
