Abstract:Mobilnost sestavlja pomemben del našega življenja, zato je nujno da je varna in zanesljiva. S pojavom naprednih tehnologij, kot so samovozeči avtomobili in droni, se pojavljajo določena vprašanja, ki se nanašajo na integracijo teh izdelkov v vsakdanje življenje in vpliva nanj. Uvodoma je prikazan tehnološki razvoj naprav, povezanih na omrežje in spremembe evropskega regulatornega okvirja v zvezi s tem. Nadalje sledi nekaj praktičnih primerov uporabe dronov in avtonomnih vozil. Magistrsko delo preučuje te tehnološke izdelke in storitve v luči prava EU glede na že veljavne primarne in sekundarne akte, kjer takšnih konkretnih predpisov še ni, pa si pomagamo s pomočjo splošnih načel in ostalih nezavezujočih aktov, ki so že bili sprejeti. Eden ključnih predpisov, ki je usmerjen na informacijsko varnost, je Splošna uredba o varstvu podatkov (t.i. GDPR), kar se izraža že v širši definiciji samega podatka v primerjavi s prejšnjo ureditvijo. Pomembna je predvsem zaradi velikega toka informacij v elektronski obliki. V zvezi s pravicami državljanov EU imamo še veliko drugih relevantnih predpisov na tem področju, kot je Direktiva v zvezi z odgovornostjo za proizvode z napako in Direktiva o elektronskem poslovanju. Kljub visokemu nivoju pravne regulacije zaščite državljanov Unije, se pojavljajo vprašanja, ali so trenutni pravni predpisi zadostni glede na prihod avtonomnih naprav. Podan je tudi pregled relevatnih aktov in predlogov v zvezi z umetno inteligenco in možnostmi za zaščito uporabnikov izdelkov, ki temeljijo na avtonomnosti. Prihodnost tehnologije je vsekakor tako zanimiva kot nepredvidljiva, kar pomeni da je še toliko bolj pomembna dosledna ureditev pravnih razmerjij med tehnološkimi giganti, potrošniki in drugimi pristojnimi institucijami. Pomemben vidik je tudi pravna poenotenost držav članic zaradi skupnega evropskega trga. V primeru prevelikih pravnih razlik bi lahko prišlo do zlorab in zaobhajanja pravnih predpisov, kar bi samo po sebi izničilo njihov temeljni namen.

Title:Legal and policy framework for the regulation of autonomous vehicles and drones in the EU
Abstract:Mobility is an important part of our lives, therefore it is necessary that it is safe and secure. With the advent of advanced technologies, such as self-driving vehicles and drones, certain questions arise. These are mainly in terms of integrating such products into everyday life and in terms of influencing it. An overview of information technology and the development of the European regulatory framework is presented. Moreover, some practical examples of the use of drones and autonomous vehicles are sketched. The Master's thesis examines such technological products and services in light of EU law in relation to already valid primary and secondary acts. Where such regulations do not yet exist, we assist ourselves with the help of general principles and other non-binding acts that have already been adopted. One of the key regulations aimed at information security is the General Data Protection Regulation (GDPR), which is already reflected in the broader definition of the data itself compared to previous legislation. The importance of such regulation is increasingly expressed due to the large flow of information in electronic form. With regard to the rights of EU citizens, we have many other relevant regulatory acts in this field, such as the Product Liability Directive and the E-Commerce Directive. Despite the high level of legal regulation of the protection of Union citizens, questions arise as to whether the current legal regulations is sufficient in view of the arrival of autonomous devices. An overview of artificial intelligence and options for protecting users of products based on autonomy is also given. The future of technology is certainly both interesting and unpredictable, which means that it is all the more important to consistently regulate legal relations between technology giants, consumers and other competent institutions. Another important aspect is the legal uniformity of the Member States due to the common European market. In the event of excessive legal differences, there could be abuses and circumvention of legal regulation, which in itself would nullify their fundamental purpose.
