Title:Uniformirane civilne interesne skupine : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:V diplomskem delu smo se ukvarjali z aktualnimi zasebnimi vojaškimi podjetji in organizacijami tako po svetu kot tudi v Sloveniji. V začetnem delu diplomske naloge smo se s pomočjo javno dostopne literature na spletu poglobili v zgodovinski primer nastanka in delovanja paravojaške enote Sturmabteilung, s katero je mogoče potegniti veliko vzporednic z aktualnim stanjem v Sloveniji – pojavom Štajerske varde. Mnoge državne vojske po svetu vse bolj uporabljajo sodelovanje z zasebnimi vojaškimi podjetji, ki prevzemajo vojaške naloge, kot so usposabljanje, obveščevalna dejavnost, zagotovitev varnosti, logistična podpora in podobne naloge. V glavnem delu diplomskega dela smo z zbiranjem informacij in aktualnih poročanj medijev preučevali, kako so zasebne vojaške organizacije urejene v posameznih državah, kakšna zakonodaja in pravna podlaga jih opredeljuje in omejuje, predstavili pa smo tudi sam nastanek, organiziranost in delovanje posameznih zasebnih vojaških organizacij v različnih državah. Ugotovili smo, da zasebne vojaške organizacije delujejo na različnih konfliktnih območjih po svetu, medtem ko pa so si njihove vloge znotraj teh območij podobne. Zasebne vojaške organizacije po svetu so regulirane tako z domačim kot tudi z mednarodnim pravom. Zakonodajo zasebniki pogosto zaobidejo, zato se pojavi težava, ker pripadniki zasebne vojaške organizacije delujejo samoiniciativno, brez pooblastil in s tem kršijo zakonodajo, za storjena dejanja pa ne odgovarjajo zaradi pomanjkljivo opredeljene pravne podlage. V preteklosti smo lahko že večkrat bili priča neodobravanju javnosti nad etičnimi in moralno spornimi dejanji zasebnikov, ki spremljajo državno vojsko na vojnih območjih in z njo sodelujejo. Ob nekaterih popravkih že obstoječe zakonodaje in določenih predpisov bi bilo možno natančneje opredeliti delovanje pripadnikov zasebnih vojaških organizacij.

Title:Uniformed civilian interest groups
Abstract:The diploma thesis deals with current private military companies around the world and in Slovenia. Based on the publicly available information on the website, the initial part of the diploma thesis deals with the case of formation and operation of the paramilitary unit called Sturmabteilung. There are many possible parallels between the case studied and the current formation of Štajerska varda (the Styrian Guard) in Slovenia. Many state armies around the world tend to cooperate with private military companies that take over some military tasks such as training, information service, security, logistic support and similar tasks. The main part of the diploma thesis includes information and current media reports on how private military companies are organized in some countries, the legislation and legal basis defining and limiting them as well as the origin, organization and operation of some private military companies in different countries. We found out that there are different crisis zones around the world where private military companies are active, however, their roles within them are similar. Private military companies around the world are regulated by both national and international law. However, regulations are often circumvented by private contractors, which leads to a problem that members of a private military company act on their own initiative, without authority and thus violate the law and do not feel responsible for their actions due to incomplete regulations. In the past, there were many cases of public disapproval of the ethically and morally controversial actions of private contractors monitoring and cooperating with the state army in war zones. With some amendments to the valid legislation and certain regulations, the activities of private military companies could be more clearly defined.
