Title:Pravica graditi v postopku izdaje gradbenega dovoljenja (legalizacije) : magistrsko delo

Abstract:Pravica graditi v postopku izdaje gradbenega dovoljenja in v postopkih legalizacije je urejena enako, bistvena razlika v veljavni ureditvi je le v primeru legalizacije objekta daljšega obstoja, kjer se ne preverja pravice graditi za gradnjo priključkov na javno infrastrukturo. Do sprejetja Gradbenega zakona na področju legalizacije ni bilo nikakršnega razvoja, zato se tudi pravica graditi v okviru postopkov legalizacije ni mogla razvijati. Z razvojem institutov legalizacije se bo razvijala tudi pravica graditi, vendar počasneje, ker nadaljnji razvoj pomeni omejevanje lastninske pravice. Dejstvo je, da so nelegalne gradnje v Sloveniji pogoste, razlog za mnoge je tudi nemožost izkazati pravico graditi, predvsem za gradnjo priključkov na javno infrastrukturo. Zaradi navedenega je potrebno tako pri razvoju legalizacije kot pri razvoju pravice graditi tehtati med statusom legalnih in nelegalnih objektov ter med zasebnim interesom čim manjših posegov in motenj na zemljiščih (lastnini) ter javnim interesom širjenja komunalne infrastrukture ter zaračunavanja dajatev. Pri tem bo potrebno paziti, da se ne bo bolj izplačalo graditi brez gradbenega dovoljenja in da se bo kršitve ustrezno sankcioniralo. Del razvoja obeh institutov ter celotne področne zakonodaje pa mora predstavljati tudi opismenjevanje prebivalstva z vidika namena in pomena gradbene ter prostorske zakonodaje.

Title:Right to build and the building permit (legalisation)
Abstract:The right to build in the process of issuing a building permit and in the legalization procedures is regulated in the same way, the essential difference in the current regulation is only in the case of legalization of a longer standing object, where the right to build for connections to public infrastructure is not checked. Until the adoption of the Construction Act, there was no development in the field of legalization, so the right to build within the legalization procedures could not be developed. With the development of legalization institutes, the right to build will also develop, but more slowly, because further development means restricting the right to property. The fact is, that illegal constructions are common in Slovenia, and the reason for many is the inability to demonstrate the right to build, especially for the construction of connections to public infrastructure. Due to the above mentioned, it is necessary to weigh between the status of legal and illegal objects and the private interest of minimizing interventions and disturbances on land (property) and the public interest in expanding communal infrastructure and charges. In doing so, care will have to be taken to ensure that it does not pay more to build without a building permit and that violations are properly sanctioned. Part of the development of both institutes and the entire sectoral legislation must also be the literacy of the population in terms of the purpose and importance of construction and spatial legislation.
