Abstract:Izraz zalezovanje ali "stalking" označuje nezaželene vdore in vmešavanje v življenje žrtve, s strani zalezovalca. Za zalezovanje je značilno, da so vdori v zasebno sfero življenja žrtve ponavljajoči, dlje časa trajajoči in da sočasno pri žrtvi vzbujajo strah in zaskrbljenost. Gre za vzorec vedenja, ki vključuje vsiljivo, trajno in ponavljajoče se vzpostavljanje kontaktov z žrtvijo, vključno z nadlegovanjem, ki je lahko osebno, po telefonu, preko pošiljanja sms sporočil, pisem, pošiljanja daril, dragih predmetov, čakanja pred stanovanjem, hišo, službo, poškodovanja predmetov in še bi lahko naštevali. S takšnim vedenjem, lahko storilec žrtvi grozi ali direktno ali indirektno. Žrtev pa zaradi tega doživlja strah, nemoč, krivdo, ogroženost ali celo depresivnost. Ravno zaradi občutljive narave problematike, katera ni prisotna samo v trenutnih družinskih razmerjih, temveč tudi širše, je bila potreba po integraciji zalezovanja kot kaznivega dejanja v KZ-1, nujna.

Title:Stalking as a brand new tipe of crime
Abstract:Stalking as a new criminal offense, we have in the Slovene legal area since November of 2015. Prior to this, the problem was very poorly regulated, namely in Article 191 of the ZK-1 in the context of domestic violence, in Article 6 of the Law on Misdemeanors Against Public Order and peace, and Article 179, paragraph 1, of the OZ, in the form of compensation for damage arising from non-material damage. It means that until the adoption of the new Article 134 a, there was not yet adequate legal remedy in the Slovenian legal area to prosecute stalking, despite its sensitive nature. The stalking or "stalking" phrase denotes unwanted intrusion and interference in the victim's life by the stalker. Stalking is characterized by the fact that intrusion into the private sphere of life is a recurring, persistent, and, at the same time, a fear or anxiety at the victim. It is a pattern of behavior that involves intrusive, permanent and recurring contact with the victim, including harassment that can be personally over the phone, sending sms messages, letters, sending gifts, expensive objects, waiting for a dwelling, a house, a job , damage to property ... With such behavior, the perpetrator may threaten the victim either directly or indirectly. A victim may experience fear, helplessness, guilt, danger or depression due to stalking. Precisely because of the sensitive nature of the problem, which is not present only in family relations or former family relationships, but also wider, the need for the integration of stalking as a criminal offense in the KZ-1 was necessary.
