Title:Kolektivno pravno varstvo na ravni Evropske unije : magistrsko delo

Abstract:Cilj magistrske naloge je predstaviti področje kolektivnega pravnega varstva potrošnikov na ravni EU ter si odgovoriti na vprašanja, ki omogočajo njegovo razumevanje. Kolektivna pravna sredstva so procesni mehanizmi na podlagi katerih je zaradi ekonomičnosti postopka in/ali učinkovitosti izvrševanja mogoče več podobnih pravnih zahtevkov združiti v eno samo tožbo. Pojavljajo se v obliki opustitvene tožbe s katero se zahteva ustavitev oz. prepoved nezakonitega dejanja, ali odškodninske tožbe, katere cilj je pridobiti nadomestilo za utrpljeno škodo. V obeh oblikah tožb gre za civilni postopek, ki se odvija med osebami zasebnega prava, ne glede na to, da je ena izmed strank »kolektiv« oz. skupina tožnikov. Do nedavno so kolektivna pravna sredstva na ravni EU bila urejana v Direktivi 2009/22/ES, ki je urejala le opustitvene tožbe, možnost vložitve kolektivnih odškodninskih tožb pa je uvedena z novo Direktivo 2020/1828, ki je zapolnila to dolgoletno pravno praznino. Magistrska naloga ugotavlja, da se je ureditev področja kolektivnega pravnega varstva potrošnikov na ravni EU po sprejetju Direktive 2020/1828 bistveno izboljšala. Oškodovanim potrošnikom je omogočen lažji dostop do ustreznih pravnih sredstev, hkrati pa so se sodišča oz. upravni organi razbremenili velikega števila ločenih tožb, kar prispeva k boljšemu izvrševanju prava na sploh. Eden izmed pomembnejših ciljev nove ureditve je doseči transparentnost in enako obravnavo vseh zastopniških organov držav članic ter potrošnikov s pomočjo uvedbe različnih pravnih varovalk pred zlorabami postopka, kar se je vsaj na teoretični ravni tudi doseglo. Kot je ugotovljeno v magistrski nalogi je podoben namen zasledovalo tudi Priporočilo Komisije z dne 11. Junija 2013, ki je zaradi svoje nezavezujoče narave imelo zelo omejen učinek na pravne ureditve držav članic. Kljub temu pa je s svojimi načeli in priporočili državam članicam postavila smernice kako urediti obravnavano področje in zagotovila dober pravni temelj za sprejetje nove direktive.

Title:Collective redress in the European Union
Abstract:The main goal of master's thesis is to present the scope of collective legal protection of consumers at the EU level and to answer the questions that enable its understanding. Collective legal remedies represent procedural mechanisms which allow more actions to be brought jointly so that the costs of the procedure for involved parties are not as high as they would be in the case of individual procedure. There are two types of collective redress; first one is injunction order for stopping or prohibiting the unlawful practice and the second one is redress order with which can the consumer demand some sort of compensation for the unlawful deed. In both forms of lawsuits, it is a civil proceeding that takes place between persons under private law, regardless of the fact that one of the parties involved is a “collective” or group of plaintiffs. Collective redress at EU level was until recently regulated in Directive 2009/22/ES which has introduced only injunction order. On the other hand, the possibility of filing redress order was introduced by new Directive 2020/1828 which filled a long-standing legal gap. The master's thesis ascertains that the regulation of the field of collective redress at EU level has significantly improved since the adaptation of Directive 2020/1828. Consumers have better access to appropriate legal remedies and at the same time the courts and administrative authorities are not burdened as much with separate lawsuits, which all together contributes to more efficient enforcement of the law in general. One of the more important objectives of the new regulation is to achieve its transparency and equal treatment of all representative bodies of the Member States and its consumers through the introduction of various legal safeguards against abuses of procedure. On the theoretical level that was achieved. As noted in the master's thesis, a similar purpose was pursued by the Commission Recommendation of 11 June 2013, which, due to its non-binding nature had a very limited effect on the legislations of the Member States. Nevertheless, with its principles and recommendations to Member Stats on how to regulate this area, it laid a good legal basis for the adoption of new directive.
