Abstract:National Security Agency (v nadaljevanju NSA), po slovensko Agencija za nacionalno varnost, je največja obveščevalna služba Združenih držav Amerike. Agencija izvaja visoko specializirane tehnološke dejavnosti, s katerimi zbira obveščevalne podatke, ki jih pridobiva s pomočjo kibernetskih operacij in informacijskih tehnoloških sredstev ter jih oblikuje v informacije, pomembne za učinkovito zagotavljanje nacionalne varnosti pred grožnjami ameriškim vladnim informacijskim sistemom in ameriškim življenjskim interesom. National Security Agency se je leta 1952, na podlagi tajnega memoranduma, preoblikovala iz Varnostne agencije za oborožene sile (AFSA). Ker velja za tajno organizacijo, je njeno delovanje prikrito javnosti, zato do sedemdesetih let 20. stoletja organizacije javnost ni poznala. NSA je vladna organizacija, zato jo opredeljujemo kot zakonito organizacijo, ki bi morala pri izvajanju svojega dela spoštovati ustavo in zakone. Najpomembnejše bi moralo biti spoštovanje temeljnih človekovih pravic in svoboščin prebivalcev Združenih držav Amerike. Kršenje temeljnih človekovih pravic in svoboščin spodkopava legitimnost in moralnost delovanja NSA. Da bi NSA užival spoštovanje javnosti, bi si moral v večji meri prizadevati za legitimnost in moralnost svojega delovanja. Cilj NSA bi moral biti zagotavljanje nacionalne varnosti in spoštovanje prebivalstva oziroma vsakega posameznika.

Title:Operation of the NSA in terms of legitimacy, legality and morality
Abstract:The National Security Agency (hereinafter NSA), in slovenian Agencija za nacionalno varnost, is the largest intelligence service of the United States. The Agency carries out highly specialized technological activities with which it collects intelligence. It obtains data through cyber operations and information technology tools and transforms it into information relevant to effectively ensuring national security against threats to the U.S. government information system and U.S. vital interests. In 1952, on the basis of a secret memorandum, the National Security Agency was transformed from the Armed Forces Security Agency (AFSA). As it is considered a secret organization, its activities are hidden from the public, so until the seventies of the 20th century, the public did not know the organization. The NSA is a government organization, which is why we also define it as a legal organization that should respect the constitution and laws in carrying out its work. The main thing, however, should be respect for the fundamental human rights and freedoms of the people of the United Nations. Violation of fundamental human rights and freedoms undermines the legitimacy and morality of the NSA’s work. In order for the NSA to enjoy the respect of the public, the public would have to strive more for legitimate and moral action. Its goal should be to ensure national security and respect for the population or each individual.
