Abstract:	Ugotavljanje verodostojnosti izjav zaslišane osebe je poleg pridobivanja informacij o kaznivem dejanju, eden izmed temeljev zaslišanj. K temu znatno pripomore premišljeno soočanje osumljenca z dokazi, ki so že pri prvem zaslišanju preiskovalcem velikokrat na voljo. Diplomsko delo obravnava eno izmed modernejših tehnik zaslišanja, tako imenovano strateško uporabo dokazov, katere uporaba v slovenskem prostoru bi lahko pokrila ta aspekt zaslišanj. Tehnika temelji na proučevanju obrambnih strategij lažnivih oziroma iskrenih osumljencev, taktičnemu razkrivanju dokazov in postavljanju vprašanj o njih. Z upoštevanjem osnovnih korakov tehnike, se poveča stopnja izjavno – dokazne neskladnosti pri lažnivcih, kar se je skozi dosedanje raziskave izkazalo za enega od zanesljivih znakov ugotavljanja zavajanja. V začetnem delu diplomske naloge je poudarek na globljem uvidu v tehniko strateškega razkritja dokazov, do katerega smo prišli s pregledom javno dostopne literature. Predstavljene so sestavne komponente tehnike, strategije izpraševalcev in obrambne strategije osumljencev, prednosti in pomanjkljivosti tehnike, ter novo razviti pristopi, ki izvirajo iz okvira omenjene tehnike. Sledi strnitev ugotovitev iz raziskav o karakteristikah moderne prakse zaslišanj osumljencev v Sloveniji, katera omogoča uvid v povezavo z lastnostmi omenjene tehnike. Opozarjamo tudi na vrsto pogojev, ki morajo biti izpolnjeni v primeru aplikacije tehnike v prakso. Na koncu naloge razpravljamo o sledeh tehnike v slovenskem prostoru, razlogih za njeno implementacijo in opomnimo na ovire, ki se pri tem pojavijo. Ugotavljamo da, Slovenska kazenska oziroma proceduralna zakonodaja zahteva, da se osumljencu pred zaslišanjem pove razloge za njegovo obdolžitev, kar pa predstavlja problem pri uporabi tehnike strateške uporabe dokazov. Tudi segmenti iz mirandinih pravic (npr. pravica do molka in pravica do zagovornika) nakazujejo, da omenjena tehnika v slovensko prakso zaslišanj ne more biti vpeljana v svojem enovitem obstoju. Pregled raziskav o sedanji slovenski praksi zbiranja obvestil od osumljencev, je pokazal da lahko posamezne korake strateške uporabe dokazov zasledimo le v nekaterih lastnostih preiskovalnega intervjuja, v katerem se usposablja slovenska policija.

Title:	Tehnika zaslišanja strateška uporaba dokazov, teoretična izhodišča
Abstract:	Determinating the credibility of a person's statements is one of the main foundations of police interviews, alongside gathering information about the crime. This is greatly helped with the prudent way in which the suspect is confronted with the evidence, which is often already available to investigators at the first interview. The thesis deals with one of the modern interview techniques, the so-called strategic use of evidence, the application of which in the Slovenian context could cover this aspect of interviewing. The technique is based on studying the defensive strategies of lying or honest suspects, tactically uncovering evidence and asking questions about it. By following the basic steps of the technique, the level of inconsistency between the suspect's statements and the evidence is increased, which has been shown to be one of the reliable signs of detecting deception in research to date. The initial part of the thesis focuses on a deeper insight into the technique of strategic evidence disclosure, which was gained through a review of the publicly available literature. It presents the components of the technique, investigators' and suspects' defence strategies, the strengths and weaknesses of the technique, as well as newly developed approaches stemming from the framework of the technique. This is followed by a summary of the modern interviewing practice in Slovenia, which gives an insight into the connection with the characteristics of this technique. We also draw attention to several conditions that must be met if the technique is to be applied in practice. At the end of the thesis, we discuss the traces of the technique in the Slovenian space, the reasons for its implementation and the obstacles that arise with it. We note that Slovenian criminal procedural law requires that the suspect is told the reasons for his/her accusation prior to the interview, which poses a problem when applying the technique of strategic use of evidence. The Miranda rights segments (e.g., the right to remain silent and the right to counsel) also suggest that this technique cannot be introduced into Slovenian practice in its unitary form. A review of research on current Slovenian interviewing practice has shown that the individual steps of the strategic use of evidence technique can be traced only in some of the features of the investigative interview in which the Slovenian police are trained.
