Title:Potrošniško kreditiranje na podlagi dovoljenja ministrstva za gospodarski razvoj in tehnologijo ter primerjava z izbranimi državami

Abstract:V diplomskem delu sem predstavila potrošniško kreditiranje na podlagi dovoljenja Ministrstva za gospodarski razvoj in tehnologijo Republike Slovenije. Podrobneje so opisani nekateri členi iz Zakona o potrošniških kreditih in Direktive o potrošniških kreditnih pogodbah. Raziskala sem kakšni so pogoji za pridobitev dovoljenja za potrošniško kreditiranje in razlike med potrošniškimi kreditnimi ponudbami v bančnem in nebančnem sektorju. Ugotovila sem, da lahko pri ponudnikih nebančnega sektorja pride do oderuških obrestnih mer in zlorab potrošnikov. Osredotočila sem se tudi na delež potrošniškega kreditiranja v Sloveniji in EU ter kako je na to vplivala epidemija Covida-19. V vseh državah se je tako zaradi epidemije poznal padec deleža potrošniških kreditov. Velik vpliv na potrošniško kreditiranje pa ima tudi digitalizacija, ki je pripomogla k čezmejnemu ponujanju potrošniških kreditov. Na koncu so predstavljene osnove potrošniškega kreditiranja na podlagi nacionalnih zakonov in Direktive o potrošnih kreditnih pogodbah v izbranih članicah EU: Italiji, Portugalski in Španiji ter primerjava zakonodaje o potrošniških kreditih v ZDA in EU. Ugotovila sem, da si je zakonodaja o potrošniških kreditih v Sloveniji in drugih državah članicah EU zelo podobna saj temelji na Direktivi o potrošniških kreditnih pogodbah, medtem ko se zakoni nekoliko razlikujejo v ZDA.

Title:Consumer lending based on the permission of the ministry of economic development and technology and comparison with other countries
Abstract:I have presented consumer credit under the licence of the Ministry of Economic Development and Technology. I have researched the conditions for becoming a consumer creditor in Consumer Credit Act and the differences between consumer credit offers in the banking and non-banking sectors. I have found out that non-banking providers can offer extortionate interest rates which leads to consumer abuse. I also focused on the share of consumer credit in Slovenia and in the EU and how this has been affected by the Covid-19 epidemic. Digitalisation has also had a major impact on consumer credit, as it has helped to offer consumer credit across the borders. At the end I discovered the basics of consumer credit based on national laws and the Consumer Credit Directive in EU Member States: Italy, Portugal and Spain and a comparison of consumer credit legislation in the US and the EU. I have found out that consumer credit legislation in Slovenia and other EU Member States are very similar, as they are based on the Consumer Credit Directive, while the laws are slightly different in the US.
