Title:Alternativni načini zaščite geografskega porekla vina v Sloveniji in Severni Makedoniji : diplomsko delo

Abstract:Magistrska naloga obravnava tematiko alternativnih načinov zaščite geografskega porekla vina v Republiki Sloveniji oziroma Evropski uniji (EU) in Republiki Severni Makedoniji. Geografsko poreklo proizvodov se v izbranih sistemih primarno in neposredno varuje prek t. i. sui generis sistema zaščite. Gre za sistem pravnih pravil in načel, s katerimi se ureja označba geografskega izvora (OGI) kot posebna pravica industrijske (intelektualne) lastnine, ki varuje geografski izvor različnih proizvodov, med njimi tudi vin. Kljub dolgoletni tradiciji tega sistema se pri pridelovalcih vin v modernem času zaradi vsebinske zahtevnosti pogojev za registracijo OGI za vina, kompleksnosti in zapletenosti postopka registracije ter izključujoče narave sistema zaščite na ravni EU vse pogosteje pojavljajo zamisli o uporabi nadomestnih orodij za zaščito geografskega porekla svojih proizvodov. Na podlagi podrobnejše vsebinske analize določb veljavnih slovenskih in makedonskih predpisov ter predpisov EU, stališč vodilne teorije prava OGI, prava znamk in konkurenčnega prava ter sodne prakse Sodišča EU avtor ugotavlja, da obstajajo številni drugi, alternativni načini varstva OGI za vina, ki niso zaščitene v okviru t. i. neposrednega sistema varstva. Kot alternativne možnosti varstva se tako kažejo predvsem kolektivna in certifikacijska znamka, varstvo pred nelojalno konkurenco, pravo označevanja proizvodov, pravo oglaševanja in pravo varstva potrošnikov. Posebna pozornost je pri tem v magistrskem delu namenjena ne samo osnovni analizi različnih institutov, ki lahko vsaj na teoretični ravni služijo kot alternativno sredstvo za varstvo geografskega imena vin, ampak tudi primerjavi ureditve teh institutov v Sloveniji (ter s tem EU) in Severni Makedoniji. Ugotovitve zaključnega dela so relevantne tudi z vidika večletnega spora med EU in Združenimi državami Amerike (ZDA) o (ne)ustreznosti sui generis sistema zaščite geografskega porekla vina. Izhajajoč iz raziskave alternativnih načinov varstva in zlasti s pomočjo primerjave zaščite geografskega porekla vina z OGI in znamkami avtor ocenjuje, da imajo OGI kot posebna vrsta pravice industrijske lastnine številne jasne in očitne prednosti, ki jih pomembno ločijo od preostalih proučevanih instrumentov. Dodana vrednost OGI je tako v izjemno širokem obsegu varstva, ki ga ti zagotavljajo svojim imetnikom, neomejenem času trajanja, neplačilu pristojbin ter odpornosti pred spremembo v generično ime in posledično izgubo zaščite.

Title:Alternative methods for protection of the geographical origin of wine in Slovenia and North Macedonia
Abstract:The thesis covers the alternative ways to protect the geographical origin of wine in the Republic of Slovenia, the European Union (EU), and the Republic of North Macedonia. The geographical origin of the products in the selected systems is primarily and directly protected within the so-called sui generis protection system. It is a system consisting of legal rules and principles governing the indications of geographical origin (IGOs) - a special industrial (intellectual) property right that protects the geographical origin of numerous products, including wines. Despite the long-lasting tradition of the said system, modern wine producers are increasingly considering the use of alternative tools to protect the geographical origin of their products due to the demandingness of the conditions for registering IGOs for wines, the complexity of the registration process, and the exhaustive nature of the protection system at the EU level. Based on the detailed substantial analysis of the applicable provisions of Slovenian, Macedonian, and EU legal acts, stances of the leading theory of IGO law, trademark and competition law, and the case-law of the Court of Justice of the European Union, the author concludes that there are many other, alternative ways of protecting IGOs for wines, which are not protected under the direct protection system. Alternative options for protection namely include collective and certification trademarks, protection against unfair competition, labeling law, advertising law, and consumer protection law. An emphasis in the thesis is given not only on the rudimentary analysis of the various institutes, which may – at least in theory – serve as alternative methods to protect the geographical name of wines, but also on the comparison of these institutes in Slovenia (and consequently the EU) and North Macedonia. Moreover, the findings of the thesis are relevant from the viewpoint of the everlasting dispute between the EU and the United States of America (USA) regarding the efficacy of the sui generis protection system. Deriving from the research on alternative protection methods and especially by comparing the protection of the geographical origin of wine with IGOs and trademarks, the author estimates that IGOs - as a special type of industrial property right - have many obvious advantages that significantly distinguish them from the other studied instruments. IGOs provide their holders with an extremely wide range of protection, have unlimited duration, do not require payment of fees, and are immune before the possibility of change to a generic name and the subsequent loss of protection.
