Title:Policijsko delo v skupnosti in uporaba diskrecije : diplomsko delo visokošolskega študijskega programa Varnost in policijsko delo

Abstract:Policijsko delo v skupnosti pomeni približevanje »represivnega« organa (policije) ljudem in njihovi skupnosti. Le z dobrim sodelovanjem lahko policija iz okolja pridobi koristne informacije, s katerimi ugotovi oziroma identificira problem, ki bi drugače zaradi svoje specifike lahko ostal skrit oziroma prikrit tako ljudem kot organom pregona. Iz tako prikritega problema bi potencialno lahko nastala velika grožnja oziroma posledica širši skupnosti. Policija s preventivnim delovanjem tako sklepa s prebivalci nekakšen most zaupanja, od katerih pridobiva koristne informacije, ki pomagajo pri operativnih uspehih policijske organizacije. Policijsko delo v skupnosti lahko pomeni tudi zadovoljiti potrebe in interese lokalne skupnosti o varnosti. Nenazadnje je delo policije namenjeno prav ljudem v neki skupnosti, zato je ocena oziroma zaupanje te skupnosti, še kako pomembno za merjenje uspešnosti policije. Diskrecijska pravica pomeni premišljeno razločevanje. Je pravica oblastnega (upravnega) organa, da lahko na podlagi zakonskega pooblastila, pri istem dejanskem stanju, sprejme dve ali več odločitev, ki so si med seboj po vsebini sicer različne, a so vse pravno pravilne. Razlika je le v bolj ali manj ugodnem izidu za stranko. V diplomskem delu je tako prikazana uporaba diskrecije (pravice) in njena »omejitev«, ki preprečuje morebitne zlorabe organa, saj lahko pri rabi diskrecije hitro pride tako do zlorabe položaja oziroma prekoračitve pooblastil kot tudi do opustitve dolžnega ravnanja. Upravni organi so vezani na načelo zakonitosti, saj diskrecija ni samovolja. Podelitev diskrecije ima svoj namen. Odločanje pa je zahtevno in zelo odgovorno.

Title:Community police work and exercise of discretion
Abstract:Community policing brings the "repressive" authority (the police) closer to the people and the community. Only through good cooperation can the police obtain practical information from the environment to identify a problem. Which otherwise, might, because of its specificities, remain hidden, concealed from both the people and the law enforcement authorities. Therefore, such a hidden problem could potentially pose a vital threat or consequence to the broader community. By taking preventive action, the police thus build a bridge of trust with the population, from which it obtains valuable information that helps in the operational success of the police organization. Community policing can also mean meeting the needs and interests of the local community's safety and security needs. Ultimately, policing is about the people of a community. Therefore, the assessment and trust of that community are all the more important to measure the performance of the police. Discretion means making informed choices. It is the right of the administrative authority to be able to exercise, based on a statutory power, the same factual and legal situation, to take two or more decisions which, although different in substance, are all legally correct. The difference lies only in the more or less favorable outcome for the party. The thesis thus illustrates the use of discretion (right) and its "limitation", which prevents possible abuse of discretion by the authority, as the use of discretion, can quickly lead to abuse of position or overstepping of powers, as well as a failure to fulfil a duty. Administrative authorities are bound by the principle of legality, as discretion is not arbitrary. Award discretion has a purpose. Decision-making is challenging and highly accountable.
